Full Version: How to Legitimate out of wedlock Child?

Ok,
So we are working on our Daughters US Citizenship and she needs to be legitimated. Method 2 applies:

Legitimation Method 2 - The person can be legitimated if:

1.
the father (unless deceased) has agreed in writing to provide financial support
for the person until the person reaches the age of 18 years and,
2.
while the person is under the age of 18 years -
1. the person is legitimated under the law of the person's residence or domicile,
2.
the father acknowledges paternity of the person in writing under oath, or
3.
the paternity of the person is established by adjudication of a competent court.

I'm not 100% clear what these three mean
CODE
    1. the person is legitimated under the law of the person's residence or domicile,
              2.  the father acknowledges paternity of the person in writing under oath, or
               3. the paternity of the person is established by adjudication of a competent court.


If any1 could explain that would be great.

At this point we are about to go for Option 2 (2. the father acknowledges paternity of the person in writing under oath)

I know The Affidavit of Acknowledgment/Admission of Paternity can be done by signing the back of the Certificate of Live birth or on a separate document

I know here in the states every state has its own version of the Affidavit of Acknowledgment/Admission of Paternity, but I didnt find any OFFICIAL form for PI yet.

I found a few sample forms people made for other countries.

I was wondering if anyone knows if a Form exists for this or is it something that is written up by myself and/or an attorney?

If you know where to get the form (if there is one) , pls post and if anyone wants the forms I found online, I can post them for u!

Hey marrs,
try the USEM manila website. that is where i got my"Affidavit of Parentage and Physical Presence in the United States".i filled this out and sent it to the embassy with all the other required stuff. I did not sign it coz i will be at the embassy for our sons appt july 7,so i will sign it them in the presence of the CO. Good Luck

Yes I have that here too and u mention a good point. It looks like on the "Affidavit of Parentage and Physical Presence in the United States"
the Signature required is supposed to b by a CO at the Embassy and not a Notar here in the states. Not sure about this......

BUT, I was talkin about "Affidavit of Acknowledgment/Admission of Paternity". Idk about ur situation,but I think u talked to my fiance b4 (bluemist), so u may know about ours. Anyway it sounds like I have to state under oath that I am the father.
Thats no problem but I just dont know for sure how to go about it!

2. the father acknowledges paternity of the person in writing under oath, BY SIGNING THE BIRTH CERTI AFTER THE BIRTH OF CHILD IN THE HOSPITAL
3. the paternity of the person is established by adjudication of a competen court .. MAYBE DNA TEST BEING REQUEST BY THE EMBASSY to USC and child

WHEN I SENT ALL THE PAPERS TO MY FIANCE ....HE SIGN IT ALL AND HE NOTARIZED THE OTHER PAPERS THERE IN US.the consul never ask anything to sign....my fiance was not there on the interview....jus follow all the instructions in the paper and its gonna be ok....goodluck to you

So basically I am a US Citizen --> and so that makes her legitimate?

Thats what I thought the very very first time I read it a while back, but getting things right sometimes makes us worry soooooo much. Im sure my fiance will ask u some more about this..but anyway thanks a millie!
