Start with the K3 guide. Are you really surprised the Consulate wouldn't issue a fiancee visa to a spouse?
Steve'sGirl
How did the petition get approved at CSC? Did you include information that you're married?
Roselinda
Seems to me that you weren't denied as in 'never going to happen'. unsure.gif

You have been denied purely because you've applied for a fiance/ee visa although you're already married.

It seems to me all you need to do is go through the procedure for a K3 visa right?

Good luck with that good.gif

or you can apply for a CR-1 (married less than 2 years) or IR-1 visa (married for more than 2 years). I suggest you do some research on your options. smile.gif
Eveline
Why would you apply for a FIANCEE VISA when you are already married??
brnidokiegurl
How did this happen? U filed k1, (then Married)? and if so why did u do this knowing it would be wrong visa. Im sure by reading on here u would know not to be married........anyway now u need prob do the cr1 and plan on about a year more wait.....i just cant believe u would start k1 then marry knowing it would stop the case as it was.
clatita

If she has not answered truthfully and they for some reason granted ther the K1 and then she went to the US under false pretenses, her AOS would have been denied and she'd have been deported.

Better now than then, if you follow.

The K3 process really isn't too much different than the K1, just a couple extra forms is all. Read the Guides at the top of the page and if you've already done the K1, the K3 shouldn't be a problem.

Im sorry this happend to you, but it did. File for a K3 or a CR-1 California processing center is pretty quick in the recent months with the married visas.
Keep all your evidence emails, letters to your husband and his to yours, etc, that you had on your K1 filings, and keep adding evidence to your new file that you will need for your interview again at the embassy for your K3 visa. I understand you being honest when she asked you if your married or not. You can do this and get thru this. Your a strong girl. And many people will be glad to help you, myself included with the forms you will need.
Its easy, only one extra form then what you had, and you need wedding photos.
Was the lady who interviewed you named Maureen? a blond headed lady???
Good luck on your new journey, you will be fine.
brnidokiegurl
yes its over and done nothing can change now BUT you knew this before because you post may 15 and acknowledge this was done> I think you see now that to wait before and not live together if that was case would have save you alot now few weeks to wait would have been easier and cheaper than to start over and wait a year more but its done now and yes u always have to tell truth. I would recommend the cr1 to file now, both taking about same time

I'm afraid nothing out of the ordinary "happened to" this couple. They are the ones who decided to get married while waiting for a fiance(e) visa. Time to stop whining and get on with filing for a spouse visa.

You will need to provide a government issued marriage certificate and translation when you file the I-130 to start the spouse visa process. If you didn't register your marriage with the government of your country, do that before filing.

Why all the judgmental comments. Dosnt anyone have any comforting advice for the poor girl? Geesh! She made a mistake and now she is trying to figure out how to fix it. No matter how the mistake was made it was made and now she is upset and dosnt know what to do.

I am sorry this happened to you. But for now ust take a monment to calm your fears and read the K-3 and the CR1 guides located on this site then you can decide wich one is best for you. Also read through the threads or do a thread search to find out from others who are going through this type of visa or who have already finished to get answers to all other questions. Tell your spouse about this site as well since he is the USC and have him read up on the choice of visa's as well. If you do not understand just ask around here on the site. There are many kind people that will be willing to help you such as PARIS HEART and KIPANDSARAHJANE. There are some other very helpful people but these two are the ones that stand out in my memory as of right now. Ignore the other comments becuase somewhere along the way those people died and became God. Anyway we are all going through pain, stress, anxiety becuase of this journey so you are sure to find someone here that will be sensative and understanding. Take care and I hope everything will work out for you and your husband.

I understand how badly you must be feeling right now. But you have to start fresh now and thats the way it is. I think its better to do I-130, it will save you a lot of $$ and time after he arrives. He will immediately get his work authorization, ssn, and be set to actively drive, work, etc.

I believe everything happens for a reason, God knows best.

Why don't you take comfort in that you were honest and file for the marriage visa. Believe me, it is much much better for him and you in the long run.

I know you are sad because you now have to wait for the K-3 but I want to point out that you did a good thing - you were honest - and because you were honest you are going to be allowed to file and receive a K-3. You are still in the game, so to speak:-). If you had lied it is unlikely you would ever have received a visa:-). So congratulations. It is too bad that you and your husband were not aware earlier that this would be the consequence of getting married with a K-1 before you arrived to the States, but it is only a delay - not a permanent road block. Good luck to you - you are still on a visa journey and I am confident that it will have a happy ending:-).

It's very sad that you guys didn't research the different visa types and what they require before starting this whole thing.
You could have saved yourself tons of time by getting married and filing a K3 from the start.

Very unfortunate.

File for a spousal visa and visit each other when you can.

Actually, I beg to differ. The CO is not a bad CO, this CO is following the prescribed protocol as laid out in the regulations. Your custom required you be married before leaving for the USA. You chose a visa process afforded only to those that are not married. Knowing your family would require that you marry, you could have saved yourself some heartache by not taking what appeared to be a faster route. In this case the CO was right, and unfortunately, you and your husband made the wrong choice. smile.gif

In this case the CO was right, and unfortunately, you and your husband made the wrong choice. smile.gif

K3 flow is almost the same with CR1 range of time after get approved @ USCIS so, i suggest go with CR1 flow.

Note: if u file K3 and get approved u will file AOS and takes time too.....while in CR1 when get approved and in USA in few weeks they will send u welcome letter and GS.
abdo
I am sorry this happened to you..,remember when GOD wants you to come to america you will come to america.
after what has happened tell your husband now to apply for K-3 visa asap and i am sure you will get your visa next year insha allah.
