I have couple of questions regarding I-864 vs. I-864EZ. I haven't received approval for CR-1/IR-1 visa yet. But, I just wanted to get this cleared up.

1. When I pay Affidavit of Support fees, will NVC send me I-864 or I-864EZ??? Or Do I decide based on questions in I-864EZ Instructions whether I am elligible to fill out I-864 EZ or not.
2. When I order tax transcripts from IRS, I don't have to send copies of my W-2 with I-864/I-864EZ, right?

If you order tax transcripts then that is all you need to have.

If you order tax transcripts then that is all you need to have.


If you use the I864EZ you have to submit your W2s...only the I864 will take transcripts alone...a VJ member received an RFE when she submitted her I864EZ with the last 3 yrs transcript....they wanted a copy of the 2007 1040 and W2s as well...

He probably submitted photocopies of his taxes, it states that if you send in photocopies provided by the IRS you must submit W2 and 1099, the instructions itself say that if you submit tax transcripts do not send in W2 or 1099.

I could be very wrong so please dont listen to me as I havent done this, if some one did get an RFE while using their Tax return transcripts then i guess to be on the safe side just send it anyway. Sucks for me because I dont have my 1040 , I think I have my W2, not sure , I hope so crying.gif

People often make the mistake of sending the 1040 without the W2's or 1099's. A tax return is not complet without the documents supporting the stated income. A transcript is complete as is.

I just filled out the EZ today. All I have is transcripts though. My 2007 is the actual copy of the w2.

Should I just tear up the EZ and fill out the regular I-864???

I have no idea, none of the big wigs as i call them are giving any clear answers, I dont have my 1040, I have my W2 from 2007 and all my tax transcripts but im confused as which to use, if i can use only my tax transcripts for the I-864 then that is what i will do because I dont have the 1040 to send along with my tax transcripts and W2 for the I864ez.

I sent I-864 with last 3 years (2007, 2006 & 2005) original tax transcripts. No 1040, no W-2 etc...

But included original employment letter and copies of all paystubs in 2008.

if you only have transcripts use the I864...its the safest choice...just more questions than the I864EZ since on the I864 you could use a co-sponser and other assets...for those questions just put N/A....thats what i used and did as well and my I864 was accepted with no problem..

I mailed I-864EZ with tax transcripts but included W-2 just for good measure but the instructions say just like pushbrk said transcripts can stand alone without W-2's

Federal Income Tax Information.
You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the 3 most recent years.

If you provide a photocopy of your tax return(s), you must include a copy of each and every FormW-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

Let me know if I am wrong.

I did read that and understood it that way but if people are getting RFE for W2 while providing tax return transcrits the issue seems to be the main page of the I-864ez checklist which states w2 are needed. Doesnt matter i guess because if i only need to supply tax return transcripts for the regulr I 864 then that is what I am going. If reading only the intructions then i would submit only the tax return transcripts but maybe the NVC doesnt know that they arent needed.I dont know what the deal is but there is no concrete answer because no one can agree on this issue. I have had a few different answers on this so the best that I can see is to just do the regular I 864 if you only want to provide tax transcripts.

Loto, please let us know how it goes this way. We'd be looking at doing the same, if transcripts do not make it on time.
We filed for 3 years+2007 MANUALLY (we were told we could not file electronically, so we filed also 2007 manually, possi bly a mistake...) this April, because we had lived abroad and never filed since. Not sure how long before the data are entered in the system by the IRS. Of course if they are not entered in the system, there is no point requesting a transcript that would stop at 2003!
Anyone got any idea how long it will take IRS, hit or miss?

If you call them, they'll tell you what's available and fax them to you immediately.

Thank you Pushbrk, but my question was: normally, how long does it take them to ADD new data to their files once received, ifsomeone files late and/or not-electronically?

I had read somewhere that it takes sometimes months..

Definitely once we get a NOA2, we will start making direct inquiries about what is available already, or how long we'll have to wait for those data to be updated..
