Okay this may be, scratch that...IS....a paranoid post but I figure we're all entitled to at least a couple on our way to getting through the immigration process.

I did get married on December 30, 2005 and my K-1 expired 03-06-06. As I was busy getting paperwork,etc in order and had no way to get to the post office in those few days prior to my K-1 becoming invalid I dropped my AOS and AP petitions off at the post office on the 7th of March, I know a day after my K-1 was up. They were received on the 10th at the Chicago location with a notice date of the 15th.

Now I know overstays are usually long drawn out things and this hadn't occured to me until today that I may have been out of status during the mailing process. The kicker is I don't have a receipt due to a money order issue a month later with said post office.

AOS was touched a few times, notably, prior to and after biometrics.

My AP has been sitting there touched once on March 20th. I know my 30-60 days aren't quite up and of course they have that extra 30 days before you can ask questions.

I just wanted not necessarily opinions from people but information from people who know whether or not my late filing could affect any area of this process. Especially with regards to using my AP, is there any way they could accuse me of overstay here and not let me back in, I'm aware it is their discretion regardless.

I've already missed one family funeral and do not want to have to go through that again.

Any information you may have will be appreciated.

There is no time limit on you filing for AOS... you dont have to file before your 90 days are up, so you will not have any problems... if you have a family funeral to go to you could have gone with evidence and got an emergency AP from your local office...

but you should be hearing something soon...
