Full Version: My fiance got here! Do we need to marry b4 EAD?

Hello everyone! I'm so happy to write that my fiance got his visa, sold his car the next day, and entered the country 2 days later! He would've come that Friday but I told him he had to spend the last Friday with him mom before he left. His family was sad for him to leave but happy for us to start our new life together. I'll post information about his interview in a different post for all those going through Casa who have to read it all (just like me).

Here's my question: Do we have to get married before he can apply for the EAD so he can work here as soon as possible? I know we have 90 days now but we'd like to plan something so I was hoping we'd have about 2 and 1/2 months before marrying but obviously I don't want to hold up the paperwork, which I don't know where to get or how to fill it out.

This site will tell me all I need to know I'm sure as I've relied on it so heavily since we began this process.

Thanks to everyone who responded so helpfully and made me calm enough to walk through the hardest part--separation. I encourage everone else out there waiting to have faith and patience, and to be super organized and act swiftly if and when you need to. Preparedness and documentation seem to be the most important elements in bringing your loved one home.

k-1 is eligible for the ead stamp at poe, some places don't stamp it, some do. it is temporary so submit the aos pdq after you get married.

Yes, you have to be married before applying for the EAD.
