Husband had interview this morning. We were so sure we had everything we needed...but noooooooooo....We had his criminal record issued from the police department - not the court house. They gave him a paper called the "Optional Form 194". I have tried to find info about it on the net and on this site, but there's not much out there. I'm assuming its not very common??? Isn't this different than the 221g we talk about all the time? Is it worse? Its says in the form that his visa request has been denied and he needs to bring his criminal record that is certified by the court house next week. None of us like to hear the word "denial". If anyone has information, please help. I would appreciate it so much as I am worried sick.

Email the embassy and let them explain more to you if there is more than this form needing to be returned/or have your state rep question what is going on

Something doesn't make sense here. You need to look at this optional form. Have your husband scan the form they gave him and e-mail it to you, so you can see clearly what is written on it. If the consulate was requiring your husband to bring in further paperwork (the criminal record issued from the court house) than this "Optional Form 194" would not have state that the visa request is denied....it would state something to the extent that the "visa cannot be issued at this time..." blah, blah and there would be instrucitons as to what the visa petitioner can do to remedy the situation and have his visa issued. DENIAL on the other hand means returning the petition (that resulted in the visa application) to be returned to the US with a recommendation of revocation.
Until you see the form given to your husband, we can't be sure if the refusal to issue the visa is temporary (i.e. he gets the court issued criminal record, presents it to the consulate and they'll issue the visa) or permanent (the petition will be returned to the US w/ recommendation to revoke).

Alternatively, you can write to the consulate, and inqure as to the result of the interview, and offer to bring the this courthouse issued criminal record fortwith to see if that is the impediment to approving your husbands visa.

He did scan the form...and it says:

" This office regrets to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under the following section(s) of the Immigration and Nationality Act. The information contained in the paragraph marked with "X" pertains to your visa application,

X = Section 221 (g) which prohibits the issuance of a visa to anyone whose appllication does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereon. The following remarks apply to your case.*
Il vous faut presenter le casier judiciare avec une traduction.
Please bring your court record and an English translation to the U.S. Consulate any day, Monday through Thursday, between 1:30 and 3:00 pm.

There is also a box that can be checked at the bottom saying "Further consideration will be given to your visa appliation after you obtain and present the docments listed above and/or the following* -

BUT, they didn't check that box!!

I am on expidite processing due to emergent medical need. This is crap. I will call the senators office now and also I am sending Casa an e-mail - hoping I can be decent smile.gif

Also, it doesn't say the word "DENIED" as i said before...i just panicked! Sorry!

yes keep checking but it just looks and sounds like he needs to bring this one form back and it will move on...(it did mention 221g then) but they only said return the form they DIDNT say will be returning petition...

It certainly doesn't sound like a denial, they are just requesting the missing information. Does your husband know where to go for this? I hope you can breathe easier now.

I agree with morocco4ever. I think they are just asking you for the court house decree. I do not look at it as a denial at all. If it was, there would be no need to bring back the missing info.

I'm sure it will all work out once that paper work is obtained and turnned in. Sucks about the delay though.

Kodi, so sorry to hear that the interview wasn't the greatest...
But not to despair too much! i believe this is the standard form that they issue when they need a missing document. He must go to the city/willayat where he was born to obtain the court document. i forget what it's called in Arabic, but i can look.

Good luck! As soon as he goes back with the document, he will be on his way, inchallah!

He got the paper on Friday - even the translation good.gif so he is off to Casa in the morning. They told him to give it to the receptionist. Is this the lady at the window on the grounds of the embassy? Or the people across the street from the embassy? I saw these people taking papers one day, so I am not sure....and I certainly don't want him to give it to the wrong person. no0pb.gif
