Full Version: new to this visa process

Hi all...

Me and my husband have been married for a couple years (he is the US citizen and I am british)... He moved over to the UK, but that hasn't worked out so he recently moved back to the US to find work and sort out accomodation, we are now going to start the process for us to be together again with me to moving over to NY with our son. TBH though, I am not in a hurry (sounds terrible doesnt it?? LOL)... I am a teacher so will be spending every 6-8 weeks with him during the school holidays... Plus our son will just be starting full time school in Sept. So realistically we are hoping for the whole process to be completed by July 2009.

Very overwhelmed with all the stuff that needs to be done though, but I guess we have a lot of time to sort it all out.

Nice to meet you all... I will probably have loads of questions...

Hmm. May be worth your while to see if you all could still file DCF if his British residency is still valid. I know you aren't in a hurry, but the I-130 is good for a year and then you don't have to enter the US until 6 months after the visa is issued. If you have been married more than two years, that would be the IR-1...maybe something to look into. London probably has rules about this I have no idea about. tongue.gif

I was just looking through the guides and I think that we will be going for the IR-1, How long is that valid for?.... It seems to be the easiest one for our current situation... The only thing I am worried about is the "may not be allowed to enter the Us while it is processing"... Is this really an occurance? Cos that would scarper my visit each holiday plans...

Also, thank you all for welcoming me... You seem like a lovely bunch of people... good.gif

The IR-1 = 10 year green card. Regardless of where you begin processing, there is the chance that you will be turned away at the POE on the POE officer's whim. It isn't common, but always a risk during processing. Another advantage of the IR-1 is the I-551 stamp that allows you to leave the country and return for short periods before you get your green card (takes about a month or two after entry with DCF). Just hope if you decide to go to Canada on the stamp before your green card you get a Canadian POE officer who is smarter about US immigration law than ours was. tongue.gif
