Full Version: I-129F for my spouse

whistling.gif ok...so I sent in the I-130 Petition for Alien Relative for my husband on May 14, 2008. They recieved the packet and i got the NOA1 (I-797 C) On May 23, 2008.

I'm now thinking of filing the I-129F for my husband so that maybe he could be able to be here with meeeee sooner!! biggrin.gif

I just want to make sure i'm doing everything all right and so i had some (probably redundant) questions i thought i'd post:

1.) Do i have to pay again? I'm pretty sure from what i've seen that i dont... but again, i want to make sure so there are no delays! (I payed already the $355 required with the I-130.)

2.) Will going this I-129F route make things more complicated later on, with adjusting his status from non-immigrant to immigrant, etc?
Though i suppose - whether complicated or not i'm still gonna try it if it means he can be here sooner cause i need my hubby!!!!! crying.gif ....but i guess i'd just like to prepare myself for anything that would be different...

3.) In the instructions for the I-129F it says that for a SPOUSE you only need to submit the "documents required in Items 1, 2, and 4 of the instructions, but may omit the documents required in Item 3." HOWEVER i dont see exactly where it says "ITEM" in the instructions, though it does say "STEP" and assuming that is what they mean i guess that "ITEM 3" (STEP 3) is just the proof of my US Citizenship, so ummm is that what they are saying i can omit? blink.gif

Which leads me to my final question of the moment:

4.) Do i need to send all of the supporting evidence that i did with the I-130? (such as emails, photos, affidavits from friends and family) I dont think it says that is required on the instructions, but i think i saw somewhere that it is suggested to send the exact same packet i sent for the I-130 and then just including the NOA1 and Form I-129F this time.... anyone who has already done this - what have you sent in?

1) If you paid for the I-130, the I-129f fee is waived.

2) Our I-129f still hasn´t been approved, so we were forced to continue at the NVC with our I-130, which gives you a CR-1/IR-1 visa instead. In the long run, it takes a little more time, but it costs less and the immigrant can work immediately.

3) I´m not sure what you´re talking about.

4) I think we sent a copy of my birth cert. or passport to show my citizenship, the G-325 forms, passport photos of both of us, plus the NOA1 receipt from the I-130.

Stick wih the I-130 CR-1]. LOT cheaper, easier and MUCH better visa in the long run.

Thanks for the info/advise so far...

i keep going back and forth with whether to pursue the I-129F or just let things go along with the I-130... blink.gif

I just dont want to wait any longer than is absolutely necessary, but i'm kind of getting the idea that a lot of people haven't really had that much faster processing with the I-129F when it comes down to it?

I suppose i'll just have to be planning another trip so we dont have to spend the entire first year of our marriage in different countries! crying.gif

That's what I did. Helps at the embassy interview also. They most always ask how many times you visited!
More the merrier!

3. The instructions were not properly corrected as to the section numbers. You definitely need to include evidence you are a US citizen. Anything that is "fiance" specific can be omitted, such as letters of intent to marry and proof you are single etc.

4. The additional supporting evidence of bona fides listed on the I-130 as "should also submit one or more of the following..." is not needed with the I-129F.

I'd check the specific full timelines for filing to visa interview for your specific country, not just the processing times at USCIS service centers before deciding whether to file the I-129F.
