Full Version: Urgent, i'm about to leave US but having 2nd thought.

So I was about to leave US to go home for many reasons. Before leaving I decided to check with USCIS why I haven't got any notification letter. It turned out they already sent 3 letters on adjustment of status, advanced parole, and EAD to us but appearantly there is a problem with my mailing address. So all those letters were sent back to the sender aaarrrrrggggghhhhh

Anyway I would like to know if the letter on AP, when you receive it, is it the actual AP? You can leave US for 6 months but what happens if u stay longer? I know the EAD u still have to do the biometrics thing.....how long will it take after the biometrics appointment before you are legal to work?

If I leave now, will I ever be allowed back in the country. I'm pretty sure my visitor visa will be canceled when I applied for K1....if I jump ship....will it be impossible for me to come back to the US?

I'm actually at the airport right now, so please help me with this ASAP.

this was what I found on the online case status after I called customer service;

On May 5, 2008, the post office returned the notice we last sent you on this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

On May 5, 2008, the post office returned the notice we last sent you on this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

On April 17, 2008, the post office returned the notice we last sent you on this case I131 APPLICATION FOR USCIS TRAVEL DOCUMENT as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.


So....how long will I have to wait till all these pull through? Any ideas?

If you leave the country now without your I-131 or your green card it is considered abandoning your green card process and you will not be allowed to re-enter the US without obtaining a K-3 or a CR-1 visa - which means starting all over again from the beginning, but you will not be allowed to be in the US with your husband for the duration. You may or may not be able to get another visitor's visa during that time.

Do call the information line listed. Tell them what has happened. Ask them to check and see what address they have on their records. Verify that it is the correct address. If not, then correct the address and ask them to re-send the information. If the address is correct I am not sure what to do. Ask them to re-send them, then physically put your name on your mailbox as well so that your postal carrier knows you live there.

If you are able to do so, make an INFOPASS appointment at your local immigration office and verify with them the address they have on file. Hopefully they will be able to resend things quickly and you will have what you need to travel.

You are taking a risk if you visit for longer than 6 months that they will also consider that you have abandoned your residency in the US. Try to keep your visit to less than 6 months and even then they make sure you can prove that you still live and plan to live in the US. Good luck.

When my husband's EAD was returned as undeliverable (despite the fact that our address was correct and we had no problem receiving everything else), we had to make an Infopass appointment to have an Immigration Officer (IO) speak to someone to have them resend the document. Prior to that, we had called the 1-800 number MULTIPLE times, but they did not resend it because the address they had on the envelope was the same as the address we were giving them. Having an IO speak to them directly pushed things along and we received the document about a week after the appointment (see my timeline).

This will be your best bet to get your documents ASAP.

Nevermind.....I guess she's gone by now anyhow. A little to late to make a descision............from the airport!

haha...I must have missed that part. I think it's a little hard to do any of your business from out of the country, but...good luck to you!

Thank you for your replies. I almost canceled my ticket home, but due to some reasons....
