Full Version: A little confused? K3 Questions

My husband currently lives with me in Canada as we had intended for him to move up here to be with myself and our 18 month old son. We have been married for about a year and a half now. My husband has become homesick and so here I am. hahaha. I have a few questions:

1. Will the fact that we've been married for almost two years effect any part of the process?

2. Can we apply for the K3 visa from inside of Canada? My husband is currently here on a visitors visa can he apply while he is here?

3. From the timelines listed below peoples comments it appears that most K3 applications take between 8-12 months, is that a typical time frame?

4. Where can I find a list of the fees for the required forms?

I really appreciate any help or suggestions smile.gif Thanks

1. That and the fact you've lived together will make evidence of bona fide relationship a breeze.

2. He can mail the petition from Canada but will need a US return address. To sponsor you, he would need a job in the US or a co-sponsor.

Has he been working in Canada while living with you, or has he been "illegally" living in Canada? If he's been there legally, you may want to investigate the Direct Consular Filing option, also found in the "Guides" section. It seems to take a lot less time then the K visa process.

They can't DCF if he is not a legal permanent resident of Canada. She said he's there on tourist visa (how he'd be there that long on tourist visa I don't know...) so DCF is not an option.
