Hi everyone, I'm down in Costa Rica. I don't know if this is in the right area or not but I'll try. My girlfriend, at the time, has been entering the U.S. under her B/1-B/2 VISA for several years now. She is a Colombian citizen with a Costa Rican residency. I am a gringo living in C.R. most of the time but return to the U.S. every summer. I am not a resident of C.R. We were recently merried in Costa Rica.
My question is would there be a problem for her to continue visiting the U.S. under her still valid VISA as my wife? And if we flew in together would I just need to fill out one customs form and enter together or do what I've always done in the past? Enter seperatly in different lines.
Thanks in advance

Did she overstay at one of her visits? As far as I know one can only enter for max 6 months under B1/B2 visa. If she violated that term, she probably would find a problem with the K3 approval. Since I am not really sure of what you said pls help explain, thanks smile.gif

Your wife should be able to attempt entry with her still valid B1/B2 visa. She will have to use the visitor's line but you can opt to stay with her if you want to fill out just one customs form. Her being able to enter though will all depend on how well she is able to prove to the immigration officer that she is going back to Costa Rica.

Thanks for the reply's. She has never overstayed any of her visits. Has been allowed 6 month's each time, but has only stayed for 1 week to a max of 3 month's last year. She has never worked in the states and we want to do everything legal so we both think it's a bad idea for her to work while in the states. She sometimes gets pounded with the questions from customs because they assume she has been working here, so I was wondering if entering together as husband and wife would eliminate those questions but it seems it might create new ones. Especially since our marriage is only 2 month's old and is not yet in the registry.
Our overall plan is to have her be with me a couple month's this summer and when she returns to C.R. I'll petition for a K3. By then our marriage would be in the C.R. registry. Then I would be in C.R. while all the paperwork is being processed. I have heard her B1/B2 would be voided awhen I petition? Still trying to learn the process.
