Full Version: lawyer advice contradicts what I thought we had to do...?

Hey Guys,

So... I have a question, I'm very confused... My lawyer said that once my fiance enters the country, we should immediately get married, then file for adjustment of status (EAD, AP), then wait to file for social security number until he gets his employment authorization.

However... on the flowchart of adjustment of status on this website, it says to apply for social security number BEFORE filing for adjustment of status and work authorization.

So the question is... can my fiance get a social security number before he gets his work authorization?

Yes, she can. She will receive a SS Card that says: "VALID FOR WORK ONLY WITH DHS AUTHORIZATION".

Your fiance can apply for a SSN about 2 weeks after entry.

After day 76 from entry, you need to wait for the EAD.

The requirement to have EAD before getting an SSN is for K3, not K1.

Yes. I got mine about 3 weeks from my arrival here and before my wedding. He doesn't need it though to get married, his passport will be enough proof of his identity

It varies state by state. Call your local county clerk's office and ask. If you explain that he will not have an SSN and is coming on a K1 they may waive that requirement.

Thanks! The county clerks office says that my fiance either needs a social security number OR an alien registration number. Will he get an alien registration number when he comes here?

The A# should be printed in his visa.
