Hi all,

To make the story short, I have filed an I751 waiver on July, 25th 2007 in Vermont Service Ctr. I have received my extension letter & Biometrics were done in September. I filed with my lawyer because I'm divorced. I'm planning on travelling next July to visit overseas for 6 weeks. I had only I551 stamp on my passport which expired in april. So I only have the expired stamp & new extension letter from USCIS. I thought I'd need a new stamp to be able to travel. I have made an info pass appointment for next week to see if I can get a new stamp since I returned my old temp green card 3 years ago. So my question is, should i worry coming back if I get a new stamp on my passport + extension letter? and what happens if I get an interview notice while I'm overseas? I live alone so nobody can check my mail. I have an online account w/ USCIS that i check from time to time. Any advice will be much appreciated.

Since you have a lawer, I guess, you can travel. USBIS should send the original notices to your lawer and copy to you. So, if there is an interview, the lawer should know about it in a first place. Keep contact with him. Make sure that you told the receptionist and paralegal at lawers office that you will be traveling. Because, lawer's office might just call you to inform and just leave a message and forger about you. Send messages to all of them (lawer, receptionist, paralegal) from abroad. Some interviews are scheduled a couple of weeks after the notice date.

I wouldn't depend on the online case status being accurate. I work in an office where we update the status of what we're doing online and I see the same thing with USCIS - when they are swamped sometimes the online status doesn't get updated until long after the actual work is done.

I would also touch base with the lawyer's office frequently since they get busy too and forget little details like not leaving a message on your home machine because you're out of town.

Why you have to return your old green card? The thing is that for travel you need to travel with your green card even is expired...that's my assumption. I have traveled a lot and they always ask for my expired green card...well they don't ask I had it inside my passport and even I have a stamp when I travel to Europe they always ask for the extension letter. When I enter the US the officer only use my green card.

To be divorce or not is not on the page since you have a I-751 pending regardless that is with a waiver is a valid I-751 pending, period.
