Hi,

First off - Yay Andres has his interview date for the 13th! We're so close!

Second - I have a feeling this has been answered before - but where is the best entry point to the US to get employment authorization? Is that authorization even valid, or does the POE not really matter?

If you want work authorization, you MUST go through JFK. No others do that.

It's hit or miss on if it works or not. Some have had great success. Others, not so much and have waited for green card.

From what I have seen it is only JFK, and even that is not a guarantee.

If a K1 beneficiary takes his or her passport to a prospective employer, are ANYONE going to feel comfortable employing them? Are we right in treating the K1 as basically a 90 day work permit?

I think the issue was needing a SS# to work, and applying for one without an EAD stamp meant you got a SS# with "not valid for work" ?

The Department of Homeland Security makes the determination on employment eligibility; all employers are required to complete an I-9, Employment Eligibility Verification. The I-9 form has a section the employee must complete: "I attest, under penalty of perjury, that I am (check one of the following):
A citizen or national of the Unvieted States
A lawful permanent resident (Alien#) A-_____________
An alien authorized to work until ____________(Alien # or Admission #______________)

I don't see how an I-94 without an authorization stamp could be used by an employer for verification purposes, since it wouldn't specifically state that authorization.

Also, from the USCIS "How Do I..." Factsheet page:
How Do I Get A Work Permit (Employment Authorization Document - EAD)?
"Who is Eligible?
* The specific categories that require an Employment Authorization Document include (but are not limited to) asylees and asylum seekers; refugees; students seeking particular types of employment; applicants to adjust to permanent residence status; people in or applying for temporary protected status; fiancés of American citizens; and dependents of foreign government officials. Please see Form I-765 (Application for Employment Authorization) for a complete list of the categories of people who must apply for an Employment Authorization Document to be able to work in the United States."

I would not be permitted to complete hiring paperwork for someone who didn't present an employment authorization document when completing their I-9 (speaking from a university research department standpoint).

Good luck for both of you at the interview! only JFK issues temporary work permits or "EAD stamp" (90 days validity). K1 visa is not enough to be allowed to work, you have to have a valid EAD stamp, EAD card (1 year validity) or green card. You can get an SS # that will be issued with the legend "valid only with dhs authorization", which means that on itself it is not proof of work eligibility.

Thanks for the info! Is it worth even trying to interview and get a job while you're still under the EAD stamp? The EAD card takes approx 90 days to receive, correct? Will an employer feel comfortable hiring someone that only has a stamp, not a card?

Some people have had good experiences, others not so much. He could work on a temp assignment for example yes.gif
