I just called the National Customer Service Center 1-800-375-5283 to ask about filling the CR-1 paperworks but I can go through to the operater...
caa you give me the instraction??? crying.gif


My husband just called them and talked to the operater but she didnt know about CR-1 visa ... blink.gif
Whats wrong with them???

what is it you need to know, there are instructions here on site and you did alot of posts earlier and had your papers ready to mail, i doubt they could instruct or answer anything until they get your papers

USCIS doesn't deal with "CR-1 paperwork". They deal with I-130 petitions. The Department of State knows about CR1 visas. I can't imagine any question you would have had that couldn't be answered here and probably already has been. If you insist on calling the misinformation line before filing, ask them about filing an I-130 for spouse.

well.... I wanted my husband to call them and find out about the difference between K-3 and CR-1 visa...he heard from his friend that K-3 visa is faster and cheeper so he called and tried to find out about it but they told him that there is no CR-1 visa and told him to aply for K-3visa....

Hmmmm...from this site ,Ive learned that CR-1 is the best option for us but my husband says K-3 is....he even says K-3 is faster and cheaper...is it true??I believe that if we file for K-3visa we have to pay about $1000 for filing for adjustment of status ....right?

Hi thanks for your reply..Ive been calling to National Customer Service Center but I cant through to anyone....how can I talk to a live operater??

I was very confused about this too.
You are right though, you should stick with the CR-1.
The K-3 is taking about the same time as the CR-1 and costs $1000.00 dollars more.
There is a lot of history about why the K-3 used to be the better option but a lot has changed.
In my opinion you should just stick with sending the I-130

ok on site here are instructions and options for both so u can compare, go by these and dont always just listen to a friend> i would guess either is going to be close to a year either way, also i filed cr1 myself so there is one still. Many of the k3 have cancel the 129 part and now become cr1 anyway (not sure if im wording this correctly). Maybe let him come on so others can explain to him what is going on.

Like others have stated, I would also recommend sticking with the CR-1. It's ultimately your choice, but I would suggest looking at what others have done in your situation.

I have been following your posts and see you are trying very hard to learn all about this. We all are. There is so much information, and at times, it is overwhelming.

Not to be harsh at all, but it appears you are doing the bulk of the research and posting. I would suggest having your husband read these forums in and out, as there is a great amount of help here. For the most part, people here know much more than the CSRs you will speak to if you try and call USCIS. They are trained to know their limited part, while people here are going through the whole process, from beginning to end.

The reason I suggest you have your husband do this research with you, is I know this must be difficult as a non native English speaker, as it is tough even for us with English as our first. I also say this because you are not the one who is sending the I-130 in, but your husband. He is the one to petition for you, so he should be asking all of these questions and getting everything prepared.

Good luck with whichever visa you choose to apply for. There are a few of us Americans on this board who have Japanese wives, so our situations relate to yours, so please feel free to ask us anything, as we are going through the same thing you are. good.gif

I considered both routes too... The best I could tell is the the CR-1 route vs K-3 route take the same amount of time for Japan. You can look at the time lines (at the top of the page goto "Immigration Timelines" ) to get an idea...

The K-3 does cost more. If money is an issue stick with the CR-1 route..

The K-3 does appear to be a little faster when you look at all countries
K3 = 313 days
CR-1 = 358 days

I looked at the stats some more... Looks like the K3 *may* be a few days faster.

So, for ~$1000 you can save <1 month out of a 12 month wait.

Its a crap shoot either way...

The historical averages don't take into account the new NVC ONLINE PAYMENT system which is shaving HUGE amounts of time off the overall process.

I would guess that with the new payment system, there is NO difference at all in time to completion between the two paths...

What do other people think about this?

whats NVC ONLINE PAYMENT system ??
i see people are talking about online payment system and they are having some problems.....what is all about?

I had no problem using it...

There are two payments that must be made to the NVC. The first one is for the petitioner most people on here call it the AOS fee (affidavit of support), the second one is the IV fee (immigrant visa) paid by the immigrant.

I, the petitioner, paid for both of them, so no issue there.

It used to take them 2-3 weeks just to mail it to you and then 2-3 weeks once you sent it back to put it in the system. Now its done instantly (well takes 2 days, but that is as instant as things get)...

So immediately after you receive the NOA2 from your service center, start calling the NVC automated line.

Wait for them to tell you the DS-3032 is generated... Immediately E-MAIL them the response, per the instructions on the wiki... saves about 2-3 weeks.

I believe there is a guide going around with all these new shortcuts. They should shave 1-2 months off your visa application....

Please use the guides to figure out all this stuff...

Why would she call the NVC? She hasn't even filed the I-130 yet.

She has the right number for asking about the process... I've used the number and didn't find it very helpful. They do know about the difference between I129F and I130 and why you would file each... that is is about it.

Just to emphasize that she has the right number... at the top of the page you posted it says:
"If you have specific questions about a case, please contact the NVC".

The OP does not have a case... she hasn't filed. The NVC only answers questions once you have your nvc case #....

Easy my friend, when I posted earlier I did not read all the posts neither realized that she had not filed the I-130 yet so we are both clear on that now. Anyaway she may have contact information for USCIS and NVC right away, that won't cause any harm to her situation.

Kiyomi, I would just contact USCIS now and ask instructions for filing I-130 and the petitioner (your husband) should do that. By filing a petition at USCIS you will have an application receipt number that will make you able to check the status online for the approval on I-130. After filing for the I-130 you'll will get NOA1 (Notice of Action) and NOA2 which is the approval of your I-130 petition.
As soon as you get approval on your I-130 you may start contacting NVC which will assign a case# to your process and will mail you the DS 3032 which is the choice of agent. That means that you're applying for a CR1 visa since NVC only mail the DS 3032 if you don't file for I-129. You may email NVC choosing your husband to be the agent (or either yourself or a lawyer), I've chosen my husband to be the agent. If you go for a CR1 visa you don't have to file for any adjustment of status after US POE (port of entry) which means that you won't have any other fees to pay.
If by the time of your US POE you have not completed 2 years of marriage you will receive a temporary I-551 Stamp and then later a Green Card by mail good for only 2 years. Ninety days before the green card expires you will have to file an I-751 form to remove it's conditional status.
