salam allaikum ,, well today is the day we should know something . insha allah . my fiance had his 1st interview on mar 13 08 , he was told at this time that he must get a police document from germany since he livved there for 7 years . we didnt think he needed 1 for germany, he had his 1 from khemisset morocco.well he then went on to the german embassy and applied for it , they said 2-3 weeks , it took 6 ... then he returnned the translatted form back to the us embassy in casa . he was told to leave his passport , which we thought as an approvval . ok , then approximately 5 days later was called to come back on may 7 th , today at 230pm his time and answer a few more questions . not that he was going to pick up an approvved visa . well , now the wait is on . he will b leavving for casa at 9am . hes takking the bus this time.last 2 times was a taxi ...... grrr anyways we dont know y they would want to ask anything more , he supplied so much evidence , the woman origuinally told him his interview went terriffic ....he only needed this form . plz anyone who cares to leave me any type of reply , id like to hear what u think . insha allah .... i met him 4 yrs ago in an islamic chat .although i took 3 years to go there , lol .. i was nervous and it was so comfortable getting close on the computer . i had never left the usa or my family before . but finally i took the chance , and immediately , we knew it was our destiny to be reunitted here in this life . alhamdolillah....plz pray for us and send back any feedback . it will all be appreciatted ,, shukran bezaf , beslama

AP/AR would be normal in these circumstances, but the MENA forum would be better.

Awwh sweetie I've been doing the same thing for the last three days- And what's worst Tunisia was having some kind of mobile network problem so I just kept getting the same message, first in Arabic and then in French that Tunisiana Network was not available and please try my call again later - I know it is sooo frustrating but I really hope that he will be out soon and have great news to share with you!!! I'm praying right now at work - Just breathe and I"m sure it's going to be just fine, Inshallah.

OMG I am so sorry to hear that crying.gif Is it something that you'd be able to contest? I hope that you have a safe trip to Morocco - Maybe if you make an appointment to go to the Embassy and talk to the Consular you can get something worked out. Again I am very sorry and wishing and hoping that you both find a way!! sad.gif

I'm so very sorry but maybe all hope is not lost yet? Some others on here have had their petitions denied and eventually got approved. Whatever you decide to do I wish you the best. rose.gif

Yes this is very normal and most of us have been through it, you will be fine Insha-Allah just BELIEVE with all your heart and it will be all right. I have see a pattern of almosy 99% visa issuance after 2nd interview - don't worry too much and pray to Allah. I am much of a worry wart too...but its not the right thing to do.
My hsuband was sent back 3 times without visa....I would be very thankful for a second interview and I believe this is good news for you.
Tell ur fiance to breath, he will do great.

salam allaikum all ,,,, my fiance was denied , due to his police background in germany where he stayyed for 7 years . he over stayyed his visa and was givven 72 hours to leave . that was 8 yrs ago . so , im now all packked and will be leavving soon to join my fiance in khemisset morocco . everyone thought that since he didnt break any american immigration laws, and that he left when he was told too , that all would be good here . its ok though , alhamdolillah . i believe ALLAH (swt) has intentions for us all . and his mother is very old and needs her son and i to care for her .maybe this is our plan . our destiny.....i wish each and every one of you the best and ill keep you all in my prayyers , as well as in my heart . and , to all my friends i met here ,, bon voyage ...lol ,, its ok , really , i do feel at ease finally with theyre decision .....the only hard part is sayying goodbye to my family . i have 3 kids they r oldder , im most worried about my daughter ashley whom, is 21 years old . she has my grandson armani , whom is 5 ....i may never see my parents again , since my father is a diabetic and had a stroke 2 yrs ago . but they have much understandding for my fiance and i . only my 3 daughters feel they r loosing theyre mom ...any advise for me to give to my girls and grandson will be much appreciatted , insha allah ,,, ill still talk with some of you from morocco , and again ,, GOOD LUCK ON YOUR JOURNEYS .......... masalama smile.gif

I dont know your case or details but i wouldnt hurry this decision, sometimes there are things that can be done to change the outcome of a first denial

Please check out all options before moving. It's easier to do from here then from there.

Whatever the final outcome, I wish you many blessings in the future.
Jenn!
Sorry to hear this! From what I've read here on VJ, I was also under the impression that overstays in other countries would have no bearing on the U.S. visa process.

Was your fiance told to file a waiver?
sarahaziz
Yes please don't take any rash actions. You don't want to be left with nothing, or nothing working in the end. Marriage is to be beneficial to both parties and their families. I'm 21 years old and I'd be devastated if my mother left abroad with somebody else. I'd def try to contact your senator of you state or call the embassy abroad to work things out.

That was my thought too. Can't you overcome this with a waiver? Not my specialty but there is a forum for this.

Whatever your choice, good luck.
Kimberlyanne
salam allaykum all, i postted in the new topics and im postting here now . i have been with VJ for 1 year , but with my fiance for 4 .. he was just interviewwed for the 2nd time and was told sorry , but NO ...... so , im off now to morocco , it wasnt hard to make this decision for me . i have been packked and ready to join my husband for a long time now . its just sayying goodbyes to my family and to my 3 daughters and grandson .my daughter ashley is takking it the harddest . she is 21 yrs old and has a 5 yr old son . i am tryying to find the most comfortting words to say to her , but this is 1 of the harddest choicces of my life. the reason my fiance was denied is that he overstayyed his visa in germany and was deportted . that makes it impossible to get a usa visa for 10 years .its been 8 . i havent said anything yet to my parents or my sisters and many many neices and nephews , cousins , aunts , and uncles , and grandparents .i am italian , and have a very large family .lol ... but i think this is a sign of ALLAH (swt) . my destiny is my husband and of course my family is very important to me . they will have my # to call me . but as for my daughters and grandson , how do u find the right words to say goodbye??????????????i wish all of you the best , and i pray that this dont happen to you as it did for us .ill still like to speak to you from morocco , insha allah .. take care all and good luck again , masalama.....
Ganja_Girl

HisLittleMasriyah

we have weighhed all options , this is the last resort. something else happenned in germany thats on his police document but that was 8 yrs ago , my husband has never done drugs but he was in a vehicle with friends that 1 was in possession of marijuana ,, thats another thing on his police report , so we have made the decision that we are going to marry there in morocco , and then do the visa process again in 2-3 years when he will possibly be eligible again .....insha allah . but he is a wonderful man with a kind heart , and he cant change what happenned 8 yrs ago , so we must sacrifice to be together . i didnt mean to go into detail regardding the incident in germany , i only wantted to make it clear . thx again

Oh, KimberlyAnne, i'm so sorry to hear this news! rose.gif rose.gif rose.gif But i am inspired by your strength and matter-of-factness, and of course, knowledge is power... at least you KNOW something now, and you can make decisions based on this...

i do, however, agree with the rest of the bunch. Are you sure you just want to up and move to Morocco? You can still overturn this decision, especially if it is just the case of a misplaced waiver.

Also, i do believe, (please someone correct me if i'm wrong), that if you are denied, you need to address the denial in some written form before you let the K-1 petition expire? i believe you need to address the denial, so if, some day in the furture, you decide to re-petition with a K3 or CR visa, you will not be denied again. Has anyone else heard of this, and if so, can you help elaborate because i'm not explaining right? wacko.gif

Whatever you decide, i wish you the best of luck. Stay strong. Inchallah, everything will work out for you and your habeeb.

I wish you peace with your decision. You don't have to say goodbye to your daughters, just see you later. You can visit and they can visit, so it is not goodbye. It will be hard on everyone and a big adjustment, but you can make it work.

As to your husband's situation, under current laws any drug related conviction with the exception of a single conviction for possession of less than 30 grams of marijuana is not waivable for an immigrant visa. There is no waiver and it is a permanent inadmissibility.

If it falls within that exception, he would be eligible to file a waiver NOW, no need to wait. If it does not fall within that exception, without a change in the law, he would never be issued an immigrant visa but he could potentially receive a non-immigrant (like B2) with a waiver (212(d)(3)/ I-192). That would require him proving he did not have immigrant intent and showing ties to his country.

I am not aware of any case where a deportation from a foreign country would require a 10 year wait for a US visa. More likely, it is the drug related incident, which I am assuming resulted in a conviction of some kind appearing on his record, that is causing the problem.

Beyond that, the work American Families United is doing with lobby efforts in Congress to change the way waivers are handled for spouses of citizens and LPRs would help, once we get it passed. If you are interested in helping that effort, check out www.americanfamiliesunited.org.

I with you luck and happiness in whatever road you choose.

It really sounds like normal processing, and the fact that they kept his passport is a good sign. My husband had to return with some additoinal paperwork too, but they kept his passport at his interview. (he only had one interview, when he handed in the additional papers, he was called in a few days) Be patient. It sounds promising to me.
