Hey guys, I filed my AOS/EAD on the 2nd of feb08 and still haven't received my EAD yet, it over 90days, i called the USCIS 1-800 the lady told me they are still working on feb filers and to wait 30days, if i don't hear anything within 30days to call them back....I have read on other sites that the USCIS 1-800 gives wrong info... I was thinking if don't hear anything after this week i will make an infopass appointment, i know that i am not the only feb filer that hasn't received their EAD yet, but mine is been 92days today from the day of filing......Do you guys think i should go ahead and make the infopass appointment or wait after 30days if i don't hear anything then make the appointment... Your advice will be gladly appreciated.

So, by law, they have 90 days from when you file to make a decision on your EAD, but that clock is technically reset if they can't process it due to an outstanding RFE, once you return the information they're seeking. (It's not fair to keep the clock running on their end if the delay is on your end, so to speak.) In practice, people have found, though, that even with an RFE they get their EAD in around 90 days.

You should probably try an Infopass appointment, but don't be surprised if there's not much they can do.

I got RFE, and my EAD and AP were proved in 56 days...

I got one RFE too and I got my EAD approval in 60 days approx. But in the letter of RFE I remember that they mention about the EAD will be processed until they receive the answer to the RFE.

I already sent back the request for evidence and case processing has resumed on march 17th, 08....I haven't heard anything since then and i am so depressed right now crying.gif

I had always been told it was 90 days from the NOA1 date, which the date they officially acknowledged it. So far that's 84 days (going by your signature), so they are still in the legal processing times. Your RFE will push that time scale back some too.

"By Law" and "Legal processing times" are misnomers. It is a general guideline for USCIS to adjudicate EADs in 90 days, not a "law" or one subject to legality.

I just called USCIS 1-800 the lady was very helpful I told her it's been over 90days since my AOS/EAD was received and nothing on EAD since it was received at the NBC and she said she was going to put in a request for me on the EAD at the NBC that i could get some kinda "interns/temporary EAD" or something while they process my AOS; she ask for the basics info like name and address phone,email and the A# and gave me a confirmation that i should i hear something within 45days ..... Anybody's EAD ever exceeded 90days before they received it , do you guys think this will help or just make an infopass appointment ??

Many people have posted they exceeded USCIS's 90 day target goal. In most cases their EAD was forthcoming. Holding fast & dear to the 90 days can really set up for some disappointment and frustration. It is in the ed, just a target. Make an infopass should you need more answers.

In my case, it has been taking 101 days since we filed I-765.
When we decided to make an appointment at INFOPASS,
our status got updated.

I have not recieved the card yet but they orderd the card
for me. Hopefully, I will get the card in a few days.

We talked to a laywer and and found out calling customer center
DOES NOT help at all. Making an appointment at infopass is the
the only thing you can do.Wish you good luck!
