Just wondering If and when my K1 visa gets approved and I move to the USA, can I apply for EI benefits? I heard somewhere that if you have been employeed for 52 weeks you can apply for EI benefits if you are moving to another country for marriage.

Thats great news, I love been CANADIAN!!! that is gonna help out so much when the move happens. I thought I would have to dwindle away my savings!!!

You can get EI, BUT you stil have to have the same qualifying hours as one would to collect in Canada

If that's the case (and I've got calls into EI AND Border Patrol), why is it, can someone please tell me, that a K3 cannot get EI. K1's and K3's fill out the exact same paperwork and go thru the same process....K3's are SPOUSES, not just fiances...why do we have less rights that a fiance...no offense but I am offended by the process. Thanks...

K3 can get EI, BUT they have to have the EAD--at least thats what been said on here--I went the CR-1 route.

I'm retiring this year and just found out they also deduct 25% from oas and cpp, they call it a none resident tax.

EAD isn't offered to a K3 visa applicant until after you get to the US...from what I understand, the K1 and K3 processes are exactly the same up to that point...no one seems to have any answers for me anywhere I turn, it's ridiculous really...

I didn't get EI until I was in the US either and I'm a K1

I'm still half asleep, so this may not make sense. Normally a k1, k3 or cr-1 doesn't quit their job until they are about to move to the USA. so everyone that is eligible to get EI, doesn't get it until they arrive in the USA. Can you get EI while stil in Canada, then transfer it over with ya when you goto the USA, I suppose under certain circumstances, but surely not if ya just quit ur job! There is 1 VJ member that was denied EI (and lost her appeals) because the EI people felt in their opinion that she quit her job too early. I didnt go the K1 or K3 route so not sure about thsoe visas. In the EI peoples eyes (which is what matters) is that k1'ers are work authorized while the K3 requires the EAD before getting EI. Cr-1/IR-1 are work authorized from day one, so EI eligible! And to add further confusion, inthe past while wasn't their a K1 VJ member that was delayed EI payments until she got a EAD? In short, a K3 can get EI, one just requires EAD.

I got EI as a K1 for the first 90 days I was in the US (granted it took them 2 months to process the whole thing so I got a bulk of payments all in Feb)
After the 90 days, i got nothing.
Once I got my EAD (2 weeks ago), my payments resumed.
granted now, they're the regular bi-weekly payments.. no more bulk ones =)
All I had to do was fax a copy of my EAD to them once I had it.
