Full Version: My Canadian children's dad died (they were living with him)

Hi, my name is Bonnie and I was a member here a few years back. I married my US husband 4 years ago.
I have three children, all teens that chose to stay in Canada with their dad then. Unfortunately their dad was killed in a tragic accident 11 days ago. I have been up here ever since and will be here for at least two months until school finishes.
They are still grieving and it's too soon to talk to them about moving to Washington, but I was wondering if anybody knows if we would be able to expidite their case once we get it going? My ex and I had shared custody even though I lived in the US. I am now the sole custodial parent as well as the legal guardian.
I guess what I'm asking for is any kind of help or advise from anyone who may have been through something similar to our case.
Only two of the kids would be coming with me as my oldest starts College this fall.
Thank you in advance for any help anybody my give me. This site was a live saver for me when I was going through the process and everyone here was always kind and helpful.

Not much known about expidite.

Did your US Citizen spouse or did you file the I-130 for your children?

US Citizen Spouse can file I-130 as step parent if marriage happened before child's 18th birthday, this gets an immediate relative visa, processing time is much like CR-1/IR-1 visa for a spouse.

Nothing has been filed yet. As I said their dad died only 11 days ago and the funeral was only two days ago.
I was hoping somebody may have been through this kind of process and may have some advice for me.

Hi Bonnie, Sorry your kids have to go through this. Maybe you could involve the senator or congressman in your area to help expedite this?
Or call the US Embassy and see if they can help?
