Hi All,

My K1 visa application has been delayed - I submitted back in August 2007, and the initial application hasn't even been processed yet. I contacted USCIS, and received this email:

"The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided below."

Has anyone else had this problem? Is there anything I can do to expedite the situation, or do I just need to wait another 6 months and complain again then? What does this mean? What are they looking for? I have no convictions, no arrests - never even had a speeding ticket! Are they worried that if I (a US citizen, currently in Utah) am allowed to marry a foreigner, I might be a security risk? Please, someone give me an idea of what's going on - I'm breaking sad.gif

There are several database checks that our petitions go through and if something comes up it is flagged until clearance can be made.

estadia was in the same situation. I'm sure she'd be happy to answer any questions you might have. She's a sweetheart. smile.gif

I'm sorry for your delay. The process is hard enough. Understand that the timeline they give you is standard for them... it could be much sooner. I hope it clears up soon for you.

Well sadly we also have been told that as well.......let me see here are the reasons they have given us far for late processing......hmmm extensive back ground investigation....they told us could be six months too but read on to what the latest excuses are lol ....security name check.......normal name check that everyone goes thru......and now last but but not least oh ur case is on its way to adjudicator......perviz and i neither one have done anything wrong ever neither been arrested or accused of anything wrong in our life's........our extended family's are pretty normal........so trust me when i say its not u its the system.............. whistling.gif dont worry they will fix the system someday as in when the head of that department has to go thru what we do oh......wait they never would cuz they have inside pull lol.....just joken.......try to stay strong and just pray thats what we are doing........sometimes it dont always work....my blood pressure is sky high and i have started to loss a lot of hair and that part is not joke.......went to the doctor he said get rid of ur stress mmmm let me see what part can i get rid of........perviz....nope ...........school.........nope........guess im stuck lol none of these are options to get rid of........

Our case took longer than most as well due to the same stuff. We're just like estadia, no history of any wrongdoings or involvement in any wrongdoings lol. We have no idea what the big deal was or why it took so long for the namecheck on us (other than I have very common first/middle AND last names). They said the standard 6 months thing to us too and it was done about 2 months after that.
Our Noa2 took about 7.5 months.
