My wife has a job in sales. After working there a few years, her new boss has put her on a "90 day" program. Where-as if her boss doesn't see noticable improvements in her sales numbers, she will no longer be working for that company, if you know what I mean.

My question is, can she file for workmans compensation if she does get released?

I am really wondering because of her status. We are waiting for her removal of conditions, and I don't know if workmans comp. is for citizens only?

I've searched our .gov site but it doesn't state anywhere about this. Wondering if anyone out there has been in this situation?

I think you mean Unemployment Insurance rather than Workman's Compensation. Workman's Compensation is paid to workers who are injured on the job and can no longer work or do their job. Unemployment Insurance is paid to individuals who, through no fault of their own, are let go by their employer. Each employee has a deduction taken from their paycheque for Unemployment Insurance premiums, so since they contributed to the program, they are entitled to receive the benefits - IF- and that is a big if - they haven't disqualified themselves from receiving benefits by contributing to their dismissal (fired for cause, etc.). Your wife should check out the Unemployment Benefits website to see if she qualifies under the conditions she is let go, if she is. Being an immigrant affected by an Affidavit of Support does not disqualify her from receiving benefits, if she is not otherwise disqualified from receiving them.

Permanent residents get unemployment benefits (my friend had). But rules are not federal, state-by-state. In some states you have to be employed for 1 year, in other less. But if she would get fired (instead of layed off), she would not get any.
PS: why she would not ask boss about new strategy to improve sales? That is what boss is for-develop solutions to stagnant sales. You wife as a dilligent sales person without supervisor responsibilities must follow the strategy. Boss is not a slave supervisor. Boss should be more experiencable, should have skills to lead salesforce and develop sales strategy. To give 90 day program without any help-sounds like your wife was just marked for layoff/firing-in-disquise and with no hope for unemployment. Wonder if there are some savings for company if they fire instead of layoff?
