This is my first topic here.

Just wanted to meet people who are petitioning for the K3 Visa and sent the docs in April!

gogo, it was bound to happen. A new April thread for 2008. Lately, it has been unusual for filers from the previous year to still be around waiting, check the K3 forum. But us April 2007 filers had it rough, still some of us waiting. If this thread was started last week, I too would have posted the same message that I was still waiting for my wife. Best of luck my friend.

Im a March filer too - Vermont. If you go to the Immigration timelines at the top of the web-page and follow the links you will see some of the April filers. There are about 7 so far.

msnoob, yours and mine are probably being handled by the same person. They are almost identical. I was hoping the touch on 04/17/2008 would yield an NOA2, and I've been looking in the mail, I guess its just wishful thinking.

I-130 NOA dated 3/17
I-130 received 3/21

I-129 mailed 3/22
I-129 NOA dated 3/25
I-129 NOA received 3/29
I-129 touch 4/16

Now just waiting... planning my next visit to St Lucia smile.gif Come on stimulus check!! rofl!!

I have checked all the april timelines and I am the only one that hasn't received a NOA yet! Pleople have sent their forms later than I did, and they have a NOA, and ME, no, I have nothing!

Is this normal? I am starting to get nervouuuus!

hi Renatchi, lots of things have happened.. =( back in November, they transferred my case to the local office.. seems like they don't like people from China.. then I had a local office interview in February 2008.. I even brought my parents and the guy said "everything is ok , you will get approval notice within 10 days".. then nothing after that.. kept calling and faxing, but everyone gives different excuses.. they didn't even give me a RFE... now I mention it every time and they said "when they need more evidence, they will send you one".. in-between all this, lots of calls and faxes to senators, congressmen, and others.. and a little recent update from my signature below..

Yeah! Husband just sent the I129F!

Hopefully we won't get any RFE!

I have noooooooo idea how Immigration works! I guess it's just luck!

Well i just realized most January 08 who got approved actually sent their papers in Sept 07 but only got NOA1 in January 08 so the VJ timelines are all messed up now...and the USCIS times actually seem accurate...ugh
Also lately they have been approving both I-130 and I-129F on the same day so I wonder what timeline we should look at....the I-130 one or the I-129F.
I'm in the US right now (been here for 3 months) and going back to France for 3 months in 2 days crying.gif
I'm gonna try to come back in August for 2 months but who knows if they'll let me through POE wacko.gif sooooo frustrating !

Exactly. I have a friend here from Brasil who sent her I130 in December, got her noa1 in February. Also she sent her I129F in February and got her noa1 in March. Still no approval. It's weird because when you compare to other timelines, I see all those people from all over the world and their K3 has already been approved a loooong time ago. But for Brazil, it takes AGES! mad.gif

I think they don't like Brazilians! They take sooooo long on our processes it's not even funny! We are goood people, you guys!! I promise! A liiiiiiittle very tiny lazy and party-animal people, but hard workers! whistling.gif

I just hope that the California SC has hired new people and started working properly and faster. I can't take 10 months away from my honey! I've heard that the USCIS is under funded, understaffed, and under trained, this is why everything takes sooo long.

I just want and need the approval ASAP. good.gif

Yeah, yeah, no wonder the timelines are all messed up.

If you sent the I129F you should look to that. If your I129F is approved before or on the same day that your I130, then you are a K3. The approval of the I129F actually decides everything. If your I129F is approved before or simultaneously with your I130, they don't process your I130 and you can go to the USA as a K3 Visa holder.

If your I130F is approved before your I129F, they "cancel" your I129F and you have to wait for the approval of the I130. This hasn't happened much, because the USCIS are trying to pass the job forward to the NVC's... lol... so they approve everything on the same day, so that it becomes a NVC problem. Get it?

I cant really be with my "Cheri" cause I'm leaving him tomorrow to go back home crying.gif I don't know if i'll be able to come back at all...and he can't come to me crying.gif

Oh, I am sorry to hear that. My husband can't come soon either. He works a lot and cannot take a vacation any time he wants. crying.gif

I cannot enter the USA while we are petitioning for a K3. I don't have a valid tourist Visa and cannot request to renew my old one (was due until 2007) because I am waiting for my K3.

The only choice we have is for him to visit me.... nooooo idea when!

Hello!!! I filed in the end of March, so I consider myself an April filer too... Im very nervous about this visa taking a year because I´ve read stories of July 2007 filers who still don´t have their visas. This waiting time is horrible!!! I still haven´t received the I-129F NOA1 and this is driving me nuts!

Welcome to the K3 journey!

I've heard about a lot of people that are still waiting for their July petition. On the other hand, I hear also a lot about people who petitioned in September and were approved in January, people who have petitioned in December and are now being approved. Most of them from other countries other than Brazil!

I am reaaally starting to think that they despise brazilians for some reason and for that it takes much much longer to allow us to enter the USA. Another point is, and I guess you can check it on the USCIS website, the USCIS has received aaaaa lot more VISA processes in July 2007 than any other year all together. They are delayed because of that. Now that they are processing the October 2007 processes, that means that they are passed that JULY rush. I guess. lol blink.gif

I am hoping and praying that my visa get's approved latest in October. Another 2 months to my interview and I could try an be with my husband by Christmas. Actually, to have the right to live with my husband and spend a Christmas with him. Come on, how insane is that? sad.gif You love somebody, marries that somebody and cannot live with your loved one? Craaazy!

Also, after a looong discussion with other brazilian women who are on the line too, we have come to a conclusion: YOU CAN ONLY COUNT ON YOUR LUCK HERE. I mean, while you are petitioning for a visa. Some get approved first, some are held back... there's no way to know. You can only hope that you are lucky enough.

I am also exactly like you. My husband works his as* off to earn some money and can't come here all the time. We all have expenses and it's very hard for him to come every 3 months like other people do.

Well, let's have some reality check and go back to the I129F NOA1 waiting line, right? lol headbonk.gif

What better Xmas present really? To finally be with ur hubby forever....that would be awesome i think when i got my visa in hand I'll crying.gif lol But I kinda imagine I wont get mine till around February 2009 (thats our wedding anniversary blush.gif )

About some countries taking longer to get approved...I got confirmation from my lawyer that it really does depend where u come from...he said one of his client was from Haiti and got approved in 3 months with CSC. He said it depends a lot on the relationship of that country with the US but couldnt tell me about France or Brazil wacko.gif

Do u guys have a lawyer as well? I wonder if it really makes a difference...

Nice to hear from you again! My husband's bday is in November - but we have even discarted speding Thanks Giving togethere. We are trying to be positive and praying that we will be together for Christmas. I do not want to spend another Xmas without him. I couldn't possibly stand that.

Sometime reality comes along and the thought of having my visa only in Feb 2009 comes along... it scares the hell out of me. NO! Our first wedding annivesary appart (married in Jan)? Hell NO!

I definetely know that it all depends from where you come from. People from Russia, Philipines and wherever else got approved and sent the I130 in October! Commeee ooooon!

For you to realize how they are here, a friend of mine who's pregnant, had to do a DNA exam before her interview in order to prove that the baby is from the USC. Unbelievable! hahahaha

This may help you guess or anticipate when USCIS will get to your petition and approve it.

You should have a K-3 prioritization date, which should basically be the date they physically received your first petition (I-130).

This is the date you want to pay attention to when determining when they will look at your petition and approve it. This is ASSUMING there are no RFE, complications, mistakes or incorrect information. Many things can cause delays, but we will hope that is not the case.
The NOA1 receipt dates do not really play in prioritizing first in / first out.
The USCIS time line is fairly general, but can give you an idea. If you want to look at VJ Time Lines, then look at the I-130 sent date for comparison. Also, keep in mind that not all VJ members are updating there time lines regularly.

Altough nothing is written in stone, this is a good guideline to go by.

On the NOA1 for the I130 the field "Priority Date" is blank. On the other hand, the field "Received Date" states 14th April 2008. Should I assume that one as a date?

We hired an attorney especially because of that, so that we don't get any documents wrong or any REF's.

Anyways, when I compare similar timelines to mine or even people who have petitioned for the K3 a little sooner than I did, they are all waaaay ahead of me. I strongly think it's because of the country I come from.

I’ve only been experiencing the K-3 process, so can’t comment on other situations.
You have to be careful about the term “Priority Date”. It doesn’t apply to K-3 Visa. That is why I call it the “K-3 Prioritization Date”. They basically use the date the I-130 petition was physically received.
So, yes, you can use your April 14th date when trying to “guesstimate” when they will approve your petition.
It is difficult to determine what madness is going on at the USCIS, because there seems to neither be little rhyme nor reason to approval times. Based on VJ timelines for CSC, I’d estimate they are concentrating on “easy” petitions received in December right now. They have been moving faster lately.
The USCIS claim they are working on October 8 petitions, but ours’ was October 29 and approved April 2.
Some petitions are approved early for humanitarian reason, (others for who knows why).
It’s just a guessing game, but at least gives you something to look toward.

We used an attorney also, so as long as you have a good attorney it will help with accuracy in the documents…which is very important for speed. I just didn’t want to make a mistake and end up back at square one…so we paid the extra cost for attorney.

I kinda know how u feel it's very hard...but we try to look at the big picture, I think about the day when i'll come to the airport and won't have to wait at the visitor's line at the customs anymore and it keeps me going.
No I'm not in France yet...I'll be tomorrow and I really don't feel like packing my suitcase I feel horrible :crying

M and K, I just said that on my I130 NOA 1 states only a “Priority Date”. Other than that, there's no “Prioritization Date”. As you said, there's a maaadness going on at USCIS. Exactly, we hired an attorney so that we wouldn't have no further delays on our process. Are you from Washington State? I see you have been recently approved! Congrats!

Loolinette, let's be positive! Hopefully soon we will have our processes approved! Maybe they mix our processes with the ones from October last year and we get approved soon! lol That COULD happen, you know? I know how you feel. I am sorry. It's horrible to say "see you soon" at the airport. It brakes my heart everytime... even when I think about my baby's blue eyes, red from all the tears, we hug and kiss like there's no tomorrow and then he has to go to the plane back to the USA. Aaaaw... but what keeps me going is that our process is moving and soon we will be together forever and nothing or no one will keep us apart ever again.

Yep, I don’t think they provide any form of prioritization dates (in our case), but this is the date they use when working on petitions. Once they join your I-129F to your I-130, they use the I-130 filing date to prioritize. This allows them to maintain (in their own minds) first in, first served. No red flags on petition will provide the fastest turn around.

Thanks,… Our petitions were approved 4/2 and NVC confirmed receipt of our I-129F yesterday. We’re getting excited now… Hope for interview first half of June. Bolivia is suppose to be pretty quick and they said they give visa same day as interview. Yes, our home is in Washington State, east side.

Time apart is very difficult and always a challenge… but learning patience and endurance will provide a foundation for a strong relationship. We’ve searched our entire lives for each other, so waiting a few months can hardly compare and is well worth it.

Yeah!! I also think that it's more like a luck thing... I have a friend also from Brazil that got her visa in only 4 months, but that was a little before July 2007. I don't know if the immigration officers really have any prejudice against us Brazilians... But it kind of makes sense... I'm worried because my husband is from PR so that means double prejudice from their side... Well, hopefully not! I hope the immigration officers like our faces on the pics and give us this visa faster!!! laughing.gif

I'm still waiting for my I-129F NOA1... It's been two weeks and I'm going crazy! I wish I could be there by September!!! Oh, well! Let's be patient, han?!

Yes, lets all pray that there is some freak thing that happens and we all get approved fast. I never imagined how difficult this would be, being aprt.

Actually, if you look at all of the timelines, of the people that fill out their timelines, it shows 52 people that have recieved their NOA1 for their I-130 between 1/1/08 and 3/3/08, and they recieved their NOA1 for their I-129F between 1/22/08 and 3/12/08. Of those 52, 17 of them have been approved. The average time for NOA2 for I-130 is 79 days and average time for I-129F is 63 days. This is all the California Service Center.

The fastest is a person that recieved their NOA1for I-130 2/9/08 and I-129F 3/6/08, they recieved their NOA2 4/9/08. That is 60 days for I-130 and 32 days for I-129.

So that timeline is actually close to the average for the ones that have been approved for the people that have filed this year.

So maybe there is hope for us. Lets just all keep praying.

Is it weird that I haven't been "touched" since I sent my I130? We have already sent the I129F last Monday (04.28) and still haven't received our NOA1 or any update or "touch". I always check the timelines, and some people get touched the very next day. Hum? helpsmilie.gif

Should I consider this good, meaning they found it ok and I hopefully won't get any REF's, or should I consider this bad, meaning they are slow and not touching my process?

Hmmm but I think those ppl who got their NOA1 for I-130 between 1/1/08 and 3/3/08 actually sent it end of last year thats what i noticed when i looked...so its messing up the stats crying.gif

If the processing time is fast like that for everybody else it would be a wonderful thing! But on my case, I've been waiting for my I-129F NOA1 for a little more than 2 weeks now.... No idea of what is going on. My husband and I are getting worried... How is it been for you guys?

I am scared of that too. I mean, I sent my I130 on the 11th April. Received my NOA on the 24th of April (date on NOA as 21st April). On the 28th April we sent our I129F to California. Still I have no news about my NOA1 for the I129F nor have had any "touches" on my I130. I know it's still verrrryyyyy early, but I've seen people who were "touched" on the first day/week, but I don't think this happens necessarily to everyone. I am scared because I do not see any "action" at the CSC. I am really starting to get verrrry anxious? lol wink.gif
