I am not too happy because my fiance's visa was denied.

The guy at the counsalate told him that he could do a I-601.How does it work and how long does it take.

If it takes too long,I'll just go back to Panama,it's bad enough I've already been without Manuel for a year.

why was it denied?
Becasue his record was not the cleanest.

Oh man that suckks. I'm not sure how long waivers take hermana, but check out both options: waiver and a move to Panama.

You will want to visit immigrate2us.net
There are lots of articles you can find about the I-601. . .You have to prove that him not returning to the US would cause you Extreme Hardship. . .this can be because of language difficulties, loss of status in employment/education, responsibilities in the U.S.; Medical problems, etc. . . there are also memorandi about how to write it, file it and document it. . .it is a long process.
If it is because of a criminal record, you will also need to show that he has "rehabilitated" be it by current status, length of time since last arrest/conviction, and/or character references for your spouse/fiance.
Like I said Immigrate2us has the best resources for this.

I am so sorry to hear that you two were denied the K-1 visa. That must be such a disappointment. It sounds like you have already decided to take it in stride and look into other options. I commend you for your strength and commitment to the relationship. I wish you the best of luck and I hope you find a more reasonable route to be together.
Did they actually give him a specific reason he was denied? And, if you don't mind me asking, had he entered the US illegally before and that is the big issue or is it legal difficulties that occured in the past within Panama? I only ask because I am close friends with a couple who are facing a similar situation. She is a US citizen, he is from a foreign country and the two tried for a K3 visa and were basically told that he could come back in 6 months to a year to consider the case. She is trying to prove the same things you were advised to do.....it is a huge pain but they are still optimistic that they can eventually get the visa. I am so sorry for the difficulties. This must be a hard time for you and I do wish you success.

He's never been to the USA.They denied him over something stupid(a robbery)he did more that 15 years ago.He had already paid a lawyer $450.00 to expunge his record.

Since it's been more than 15 years with no repeat offenses, it should be relatively easy to overcome. Do take a look at immigrate2us.net. . .the law is not always fun to deal with but it CAN be done! Good luck :-)

I just came from a lawyer's office.He is also a judge.He told me that since we're not married that I can't even do the waiver.I have to go back to Panama,marry him,do the I-130,and then do the waiver when he gets denied AGAIN.

Your lawyer is wrong, lots of lawyers make this mistake. Fiances can file the 601, just the same as spouses. . .they qualify just the same. Check on this site and on immigrate2us.net for "kitkat." She and others have done it successfully.
If you want a good attorney for 601's also check out visacentral.net for Laurel Scott. You will only lose time and money if you go back to the beginning of the process.

Let me clarify, if you are a U.S. Citizen, as a fiance you are eligible to file the I-601. If you look on the attorney website I furnished, the very first paragraph describing the 601 tells you that a USC is eligible to file the 601. This attorney is very experienced with this type of waiver.

Listen dont get too stressed out, some people with normal administrative processing have time frames like the denials, if you file the waiver it should not take an extremely long time, especially if you go there to be with him during that time.

I found out soon after that one of his office flunkies gave me this wrong information,it wasn't him.

Did you report the flunkie? If you had believed that person and not done research you might have gone away and lost a lot of time and money! They aren't supposed to give out legal advice if not qualified. . .it is very serious what they could have done to your case.

No.But I did call the flunkie back and ask her why she gave me false information.She got nervous and tried to say she didn't know what I was talking about and then she finally admitted that she said that becasue she was unfamiliar with cases like mine.Most lawyers here are very familiar with waivers when it involves illegal entry to the USA,not a prior charge from years ago.
