If you are the beneficiary, then yes, you might as well send your BC. A lot of people received RFE for that one. Believe it or not, I even sent a CENOMAR as a proof that I am capable and free to marry my then fiance.

BTW, I supposed you are on K1? You should post in K1 sections.

Sorry I am confused too now.

Does the US SPOUSE need to file his/her Birth Certificate at any point in the process? When filing I-130/I-129F? At interview at the embassy? When doing AOS?

I understand that the NON-US citizen needs his/her at the time of the interview. Not sure about the US Citizen's. I was wondering that too.

Perhaps copy of US passport and if he is a naturalized citizen, copy of naturalization certificate are enough? Only difference is that the BC should have parents' name too.. But what in case your BC name does not fully match your passport name, for example because of a foreign alphabet discrepancy??

did they really got an RFE not submitting the beneficiary's birth cert.? I have read posts that the beneficiary's BC don't need to be submitted and also we followed the k1 Guide stating only the petitioner's BC as proof of citizenship. Now this makes me confused also and worried since I didn't submit. sad.gif

When i filed I-i30 i attached a copy of my husband BC and our MC. Then at the time when they asked me to fill up the ds-230 they ask me to attached the certified/original copy of his BC and MC. But make sure that you have at least another original copy on the time of the interview for your files...

Reading from Instructions to File I-130,
Birth Cert. is required for Petitioner if petitioner is born in US and wants to use BC to establish that he/she is citizen of US.
Birth Cert. is NOT required for Petitioner if petitioner is born in country other than US. Copy of Passport/Naturalization Cert. is required to establish citizenship.
No where in instructions it says, Birth Cert. for beneficiary is required. I didn't put my wife (beneficiary) BC with I-130 and G-325A. I am just hoping/praying that I don't get RFE for my wife BC as Instructions says BC for beneficiary is NOT required.
