Full Version: Can bankruptcy effect processing of K3 visa for my wife to bring her here?

huh.gif I have horrible debt. I live in California USA. I have a wonderful wife in the Philippines. I am about to file K3 visa however, Today I was served a summons that I am being sued by Citibank for a past debt. Last week i was served summons from another USA Bank. This is the second time and the amount could reach over 80,000$ in which i can not pay off. Either between my wife and I we pay this debt until we are 70 years old or declare bankruptcy. I have only a few weeks to reply.

Really i have two questions.

1. Can Bankruptcy interfere with the K3 and or keep my wife from coming to USA

2. If I do not have a bank account (they will take money out of my account leaving me in the red making me owe more) can that interfere with AF of support? Can i still bring my wife here with NO bank account?

If anyone can answer these 2 questions for me that would be a great help..

Bankruptcy or credit issues are not considered in the visa process. You will still need to qualify with income or a co-sponsor.

Hi John,
I'm a k3 beneficiary also...or at least i'll be after i go to the Romanian consulate for my visa. From what i know, your financial situation doesn't matter for the K3,because anyone can fill out the I-134 Affidavit support for you if you don't meet the financial requirements. I called the United States embassy in Bucharest today to ask if a friend of my husband's can fill out the affidavit of support for him. And the lady on the phone said yes. So, i think you're fine. Good luck with your debt though!

Debt has not effected a single part of our journey thus far.

At some point you will file an affidavite of support, first for your K-3 package. That package allows her to be interviewed there, and bring HER version of the package which has an updated affidavit of support. Once she is her, and applies for citezenship, then -you got it - a third one.

I am glad to see others are not detered or have not had occurences of debt affecting them, but you said BANKRUPTCY. Call USCIS and ask. You have at least two years before she gts close to getting here so you have decisons to make and to come up with a plan.

The affidavit is the US citizen showing the government that they can support the new immigrant until they are allowed to work, and then some. My package (all thre) had three years worth of W-2s, 1099s and Tax forms, plus a couple of paycheck stubs. Honestly, I have spoken with folks on here who have been bankrupt, and I remember a forum on here about financial suipport - it IS NOT impossible, but it doesn't make it easier either.

I also have seen statistics on countries immigrants come from, and the poorer the country by US standards, the harder the embassy looks.Not to scare you, but that was a realistic assessment of the process, and she is interviewed by Filipinos at several points before she gets to the US Embassy employee. Your finances are key there becuase they are also looking out for the welfare of their citizen. They unfortunately have cases of girls that are more like indentured servants than wives.

To offset the bankrupcy, keep e-mail logs, IM logs, phone and text bills, letters, cards and packages. So them the love is ral, and make a difference in your current situation - That is the strongest way for you to get through this.

Filing bankcruptcy now in USA is very common since we all know that the country is under recession(???). Anyhow, it will not affect your K3 petition just make sure you can produce the affidavit of support beyond the poverty line. Goodluck!
