Full Version: Question? Isn't K3 visa a much better option than CR1 if...
VisaJourney.com > Marriage Based Immigration (K1, K2, K3, etc) to the USA > IR-1 / CR-1 Spouse Visa General Discussion

I was re-thinking the steps I have made thus far....but what do you think.

Obviously its cheaper to go the CR1 way for the spouse to come as an immigrant. But I want his children here at the same time using his K3 (and the kids K4) so they may all come together with their dad (sooner) rather than waiting to file CR1 for the kids separately and prolonging their journey. I'd rather file for them when they are here and I can space out filing expenses.

If I had opted for just the CR1, would the kids have been able to come with him on the same flight without me having to file separate petitions?

Thanks in advance for your responses.

K-4's could have been issued at the same time as the K-3. Each K-4 eventually needs an I-130 in order to adjust status.

CR-1 doers NOT have *automatic* derivative benefit like the K-3 does. So without approved I-130's for the kids, no CR-1 visa would be issued.

If you wanted all to arrive on CR1 and CR2 visas, you would have filed I-130's for each in the beginning and skipped the I-129F for spouse. You are now on the K3/K4 path.

If you want an immigrant visa, don't file an I-129F for spouse.
