I filed an I-134 with my original I-129(f) application, even though it might not have been necessary to do so. But that was last August. Do you think I should fill out a new one? The only thing that would be different is the date, my income was a little bit less in 2007 (but still well above the red zone), and I have a LOT more money in the bank now. What do you think?

I don't really know but I would ger a new one for the interview ....just to make sure star_smile.gif

Yes, the I-134 is supposed to be presented at the K1 interview. Update your info, and send more recent paystubs.

Good question. I wasn't going to fill out a new I-134. I just have the most recent data on my income such as: latest paycheck, 2007 IRS transcript and 2007 W2. I don't see any reason to fill out a new form but I guess it can't hurt. You can never have too much evidence!

I sent an I-134 form in with my original I-129F application, but I also filled out an entirely new I-134 form for my fiancee's interview.

OK, I got another I-134 filled out. Simple enough. OK, why can nothing be simple? 1st: Since I filed one before, I put that I filed one before, right? Even though it was for the same pending application, and hasn't really had a chance to take effect? 2nd: The first one, filled out by a lawyer, I believe was filled out incorrectly. It put BOTH my fiancee and my son as full dependents. The question is worded in the present, not the future. So I am thinking my fiancee shouldn't have been on there? She is not dependent on me financially, and certainly not fully dependent. She WILL be, of course, but I can't go crossing out words on the form now, can I? Even my son is not FULLY dependent on me, it is spelled out fairly clearly in the divorce decree who is responsible for what, and what costs will be split.

What to do, what to do.


1st. A cover letter explaining the reason(s) for updating (or replacing) the I-134 is a good idea since the Consulate already has the one filed with the I-129f. A call and/or email to them is also a good idea so you have a record of telling them about the change. If you call, try to the name of who you talk to and/or get them to make of note about this in your case file.

2nd. Dependents on the I-134 are the ones listed on your tax return for the year(s) that you are submiting with the I-134. Unless you claimed her as a dependent, she's not to be listed. If you listed your son as a dependent on your taxes, then he should be listed in the same way on the I-134. If you are thinking of crossing out things on the original I-134, no, that will only confuse the Consulate in my opinion. A correct I-134 with the necessary evidence with the cover letter explaining why you have two different I-134s should be fine.
