Has anyone gone through the Bulgarian embassy for 601 waiver??
My husband will be going home in June to do a interview. He has been in USA illegally for 10 years so I Know we will have to have 601 LETTER READY........
Who writes the letter, me or my lawyer???

If your husband entered legally on a visa then you should be doing an adjustment of status. . .overstays are forgiven for spouse of USC as long as the beneficiary entered legally.

DO NOT LET HIM LEAVE THE COUNTRY IF HE ENTERED LEGALLY. . .as soon as he leaves, the ban becomes effective.

If your husband entered legally on a visa then you should be doing an adjustment of status. . .overstays are forgiven for spouse of USC as long as the beneficiary entered legally.

We already have everything started.. he was approved for the 130 and 129, but we are already married.. we have a lawyer, he has to go home for the interview.. I am pretty sure he will denied visa and we have to the hardship letter right??? 601 waiver??

Why would he have to go home for the interview? It all depends on how your husband initially entered the US. If he entered the US (even 10 years ago) on a valid visa, then you can adjust status from within the US...even 10 years later.(You file the I-130 and I-485 concurrently.) Overstays are forgiven upon marriage to a US citizen.
If he came into the US without inspection (what is termed illegal) he does not have this option, and will have to return to home country for the visa interview, which as you correctly state will be denied. At that time, the CO will inform him of his waiver eligibilities.
The hardship letter will need to be written by the USC (with the help of a lawyer if you have one) demonstrating why the USC can't move the the foreign beneficiary's country and reside there.
It is my understanding that waivers are pretty lengthy procedures, but I don't know specific time frames. Maybe someone who knows more can chime in.

I know he has to go home in order to come back.. I guess i have to write the hardship letter... i am so stressed out over all this stuff. But all these posts have helped!!I just dont want him stuck home for months! any advice!!!

But he will be stuck there for months...possibly for 10 years....depends on the hardships that YOU present.....what do you mean who writes the 601???...the lawyer is just submitting your hardships to a document........you will need valid documented hardships,

Take a look at the immigrate2us.net website . . .the waiver depends on the strength of your packet. . .lots of different aspects to the letter, not just one.
