I have not been on here for awhile. Fiance is having problems with a charge on the police certificate. It says that he has a pending court case from almost 10 years ago. He never knew about this and is trying to get it resoloved. If he went ahead to the embassy with this case pending would it be a problem with the embassy should he wait to get it cleared up or proceed with the embassy and take his chances?
Everything is going to depend on what the charges are, as well as where they occured. If it is not listed as a crime involving moral turpitude, there should be no problem, but he will need to take all papework involved in the court case/charge itself and all of the paperwork he's accumulated in trying to clear up the case. I would probably consult an attorney either way to advise you on whether you need to postpone the interview.
I would say no, but that is just so you could ask these questions in person, and take the risk that they will issue the visa anyway. (As long as not a CIMT.)
