I think our dates are pretty similar; VSC mailed my NOA1 on 2/6 and I received it around 2/10. I am still waiting my NOA2. You on the same boat?

Good luck to her! Did you get visit visa before your relative petition or after ???

Good luck to your immigration process, Amastar ! Yes, she is pretty too star_smile.gif

I pray all goes well for you.

No, Japan is part of the VWP so a visitor visa is not needed.
HOWEVER, she could still get turned away at the POE tomorrow if they thought she was trying to immigrate early. I'm really worried because her belly is getting bigger and I dont know how they will look at that.

Thank you for the compliment. I think so too. smile.gif

hey hey, just out of curiosity, how do you communicate with your wife? in English or Japanese? My wife doesn't speak much of English and my Japanese is below-average. I mean I can get my points across but we seldom can have a fluent conversation...she probably married me because of my hotness..j/k smile.gif

We use both. Her english isnt really good and my Japanese is just good enough to get by. So there are still alot of times where I have to repeat things or say something in a different way. Sometimes I sound like Yoda talking.
I need to keep learning more Japanese though! I can communicate great with my wife but with her friend or family I struuuuuuggggglllleeee.

That's awesome. I am probably at exactly the same situation as you are. Sometimes I feel a lack of sentence structure and often just use words or phrases. I am a member of the Yoda club too...I wonder if VSC would be susceptible to Jedi mind trick..

I'm actually in japan now, waiting for my wife to give birth (sometime in the next two weeks).

Am just wishing you both ... and baby .... goodluck for today .... my fingers and toes are crossed for a smooth journey for your wife and a hassle free entry through POE. Please let us all know how it goes.

First off thank you everyone for the good wishes!
Secondly,
My wife is here with absolutely no problems at all at the POE here in DFW
She says they asked her a couple of questions about who are you here to visit and thats it.
My wife told them right away that we are waiting on the visa. She didnt have to show any paper work or anything!
It took almost an hour and a half from the time the plane landed until she got to me. But it was because there were so
many people and not because she got held up.
I was starting to freak out.

Now she is asleep in my room with her cute little belly!
Im so happy!!

I hope everyone else gets to be with their loved ones soon too.

huuray!
that's awesome that your wife can come here:) I don't know why immigration attorneys always scare us not to attempt. I have never heard anyone who got turned back. Your wife is already an extreme case (pregnant and without job at Japan) and she still got in okay. Maybe I should tell my wife to come for a visit as well...

Me and my wife were saying the same thing.
I dont think Ive ever heard of anyone from Japan getting turned away.
If my wife can get in with a big baby bump I dont know why anyone else would get turned away.

Amastar,
obviously you have done lots of homework regarding this issue (visiting US during I-130 petition). Do you think, or have you heard, that there would be any negative effect of such visit at the consulate interview? would the interviewing officer give your wife a hard time for making such visit?

I've never heard of that happening. The main thing I was worried about was how it would look if she got denied entry.
I think though as long as she can show on her passport that she left before her 90 days was up and didnt overstay I dont think there is anything to worry about.
Cause technically there isnt any law against people coming to visit while waiting for a visa. Its all up to the Immigration officer at the POE.
If he thinks she is a risk to immigrate illegally then he wont let her in.

But then again Ive heard this over and over again but Ive never read about an actual IO not letting someone in.
Im sure it happens but I just havent seen it happen.
Im not sure why lawyers and other people scare us like they do.

I dont know if I answered your question or not. I hope I helped.

I think the laywers are afraid the denial of entry would delay the Visa process (like a black mark). I am sure there are people got denied entry, but the percentage maybe as low as 0.001%. I guess lawyers are not taking any chances, no matter how safe it might seem..

On a subsequent note, I have noticed that some forums allege that even if your spouse is granted entry during the I-130 process, such trip would generate additional FBI name check (if it has already been done), which could delay the processing time at the consulate. Anybody has any thought or experience from that?

I was under the same impression after reading many posts concerning this subject .... however, I've actually checked out the next set of paperwork for the NVC section and that's when your flights are taken into consideration ..... you have to list every flight you've every made to the US on one the forms ..... I'm actually having a nightmare with it as I've been travelling there for 30 years!!! wacko.gif

Plus, there is no where on any of the forms for you to list 'refused entry at POE' ..... it only tells you to list flight dates for where you have actually entered the U.S. .... and which visa you came in on.

But, at least it shows that up until the NVC stage, you're quite safe as far as FBI checks and flights are concerned ..... too much scaremongering going on, and not enough factual evidence.
My goodness how this process has us all wetting our pants for the slightest thing at times eb0dfafc.gif

Can anyone direct me to where I can get this information of what you will have to list on subsequent paperwork? Listing all flights to US? Geez... that might be tough getting that info together... maybe all our old credit card statements... or stamps on his passport?

It's on the DS-230 part1 form ..... question 25. "List dates of all previous visits or residence in the United States (if never, write never) Give type of visa status, if known ....."
They give you 3 spaces for your visits wacko.gif ..... it's a nightmare if you've been travelling there for many years.

That's great news!! Very happy for your wife, and I hope I can get through too next week!!!
Did they ask her how long she is going to stay?

Yes, They asked her how long she is staying and who she is visiting.
She was 100% honest about everything.
They said "why do you live in Japan and your husband here"
She said "because we are waiting on the Visa"

She said the lady just handed her passport back to her and said "enjoy your visit"

I hope my experience can help other people visit their loved ones.
I havent really been able to sleep because Im so happy(among other things hehe)!!

Enjoy!
