How long it will take for entire immigraiton process? Is this would be CR1 or IR 1 Categorie? Wha we need? I have lot of quesiton regarding applying for petition for mother in law

Is your wife a US Citizen now? If yes it would be an IR and you would file an I-130.

Your wife can only file for her mother if she is a USC.... you would need to file a I-130 and the visa that would result would be a IR-5... it takes about a year to get from filling the I-130 depending on interview availablility of interview in the country where her mother lives.....

You can not file for a mother-in-law only your wife can....

That would be...that SHE would file. She would have to be a US Citizen. You cannot file for mothers-in-law (thank goodness!!!)

That would be...that SHE would file. She would have to be a US Citizen. You cannot file for mothers-in-law (thank goodness!!!)

lol you guys guessed it right. I am USC she is not USC she holds 2 year probationer green card right now in india New delhi. She saying she wont come back until her mother comes back with her. So I said fine bring her with you on visitor visa or soemthing her mother is like 48 year old.

So does my wife have to become USC first how long it will take may be i think 5 year at most then her mother can come here

or

Her mother can apply for visitor visa? am i right?

Your mother in law can apply for a visitors visa.

Your wife need to stay in US for 3 years to get his Naturalization and be a US Citizen then she can able to get her Mom under IR1 category.

Let me get this right... Your wife is refusing to come back to the US and you until her mother can come with her???? is she aware that she will lose her greencard status if she remains outside the US for too long..... her mother could apply for a visitor visa but unless she has very strong ties to her home country she is not likely to be approved.... what will your wife do then???

Your mother in law can come on a Visitor's visa if she can get one, but the stay here in the U.S. will be limited (at most she can stay is 6 months). To figure out how long it will take to get your mother-in-law here on a IR5 visa, calculate:

3 years+ before your wife can apply for citizenship
1 year + for her Naturalization application process
1 year+ processing time of I-130

So, at least 5 years is a good estimate.

I don't want to scare you, but I divorced my first wife , because she didn't want to do anything without her mother

That is no reason to divorce, there has to be more to it than only because your wife would do anything without her mother.

You need to explain the process with your wife that she cannot stay out of the US too long or she will loose her status and it will take that much longer for her mother to come here.
