Hello VJ Forumers,

It seems that DCF is only allowed for USC and not for US permanent resident. Can somebody confirm (and kill somebody's hope)?

If so, what would be the best choice to sponsor a spouse from France for a US permanent resident???

Thank you for your comments.

NO no0pb.gif I-130 has to be filed at USCIS, and will be held for a long time by USCIS and then NVC until a visa number comes up for the immigrant. Spouse of a LPR is F2A See bulletin for processing of I-130 in this case http://travel.state.gov/visa/frvi/bulletin...letin_4177.html

Effective immediately, consular posts abroad will accept petitions for immediate relative immigrant classification from American citizens who are resident in their consular districts, including members of the armed forces, as well as true emergency cases, such as life and death or health and safety, and others determined to be in the national interest.

The U.S. Embassy in Paris will accept immediate relative immigrant visa (or I-130) petitions from American citizens who have been continuously, legally resident in France for at least the six months prior to petition filing. Individuals, who are in the country on a temporary status, such as student or tourist, do not meet this residency standard and must file with USCIS in the United States.

Only option for a US permanent resident is to file form I-130 to USCIS, and then file N-400 and become a US Citizen as soon as they can (5 years after becoming a US Permanent Resident). When you do become a citizen, you can get the pending petition upgraded from F2A to IR-1 Un-limited Class Visa.
