Full Version: Does child support count towards my income for I-134?

Ok so I presently only make at the 100% mark but with child support that I receive for my daughter that puts us above the 125% poverty line for the I-134....soooooooo will I need a cosponsor or should we be ok? I just have one daughter and myself in my household and then Gareth will make the 3 of us smile.gif So not too clear on what I should look at on the chart....

You can't claim child support. Conversely, the (presumably) ex-husband, even though he's paying it out, would be able to claim it as income. The point being that it's his income, not yours.

You can't claim child support. Conversely, the (presumably) ex-husband, even though he's paying it out, would be able to claim it as income. The point being that it's his income, not yours.



That's not what the embassy told me after I emailed them. I used child support and that is what put me over the 125%. I did not use a co-sponsor either. I included a copy of the child support withholding order. and several copies of the checks from the last several months. I had no problem.

I don't agree with that. Whenever I fill out any kind of credit forms they allow you to claim child support as income, if you wish. At times I have. At other times, I haven't needed to.

I've always felt it's an if you want to kind of thing.

Very cool thank you! We have just been doing it on honor system since last June but just this month it is starting to go through the courts so I will just send a copy of the child support order but it also will obviously show in my bank deposits as well.

Only court ordered child support can be used as income in an affidavit of support.

Well it has been court ordered since January. OUr divorce was just finalized in January. He has been paying me though since June when me and my daughter moved back here to the US so at least I have had that going into my account....So I would think with the letter from my job showing I have a permanent full time position and that I have had steady deposits into my account I should be ok to sponser him myself. I am sure my grandparents would co-sponser if needed.

Part 6, Item 23 of the instructions for the I864 clearly state that child support can be counted.

As it is allowed on that document, most consulates will allow it on the I134.

I showed child support on my affidavit. I showed the decree and bank statements wherein the deposits for the support were made.
