Here is my original posting followed by an update:
Greetings. My immigration attorney submitted my first I-129F Petition back in September of 2007. It was received by the California Service Center on September 20. Someone at the California Service Center incorrectly classified it as an I-130 and sent it to the Chicago lock box to be processed. In Chicago they correctly identified it as an I-129F Petition and instead of sending it back to the California Service center to be processed they sent it back to my attorney and issued me a rejection noticed because it was out of their jurisdiction. I re-filed and received my first NOA dated January 14, 2008. Since that time I have been trying to get USCIS to put me back in line where I would have been if it had not been for their mistake. So far I've had no luck though almost 2 months ago an adjucating office at the California Service asked my attorney's congressman for documentation which was sent at that time. I haven’t had any luck trying to find a way to contact the California Service Center by telephone.
Has anyone had a similar circumstance and if so what was the outcome?

UPDATE: I spoke with someone at the USCIS National Service this morning who was actually very helpful. He took all my information, gave me a confirmation number and said if I didn't have my NOA 2 by April 27 to call them back. I'll let you know if it really happens. I am going to remain positive and optimistic!

What colossal screw up on their part! But it sounds like they are getting you back on track. I'm glad to hear that. Here's hoping the next steps will go smoothly for you!

Hi, I'm in the exact same situation. Congressman just sent proof of my sept. filing. I'm waiting for their response to him.

Actually, i just checked and my congressman's rep seems to be acting rather slow so i think i may try the RFE line given that i do have an RFE though not in the technical sense.

I tried the Senator Finestien route and her worker messed up all the information and documentation I sent her so badly that I sent her back a letter and said "about the only information you got correct was my name and address." I added at the end of the letter to Fineswine's " please tell me why if you can't assisit me in resolving a reasonably simple and straight forward mistake like this then why should I trust you to solve the complex problems facing our country." I didn't receive a reply back.

It's amazing that USCIS can make this many errors and not be accountable to fix them in shorter than a few months time! They would nevermake it in the private sector!
And I say again if we get government managed health care why should we expect any different type of treatment than we are getting from USCIS?
