Full Version: We've been married for 16yrs....Does this mean I have to go with IR-1/CR-1?

We find ourselves here after raising 3 kids in Toronto for the last 16 years. Due to an illness in my wifes family we had to uproot and start this ridiculos process.

When I met my wife we decided to start a family in T.O instead of L.A and it literally took us 3 months before this girl got her PR, her SIN, her drivers license....health card....etc. etc...if we would of decided on LA.....based on these wait times I would of missed the births of my first two kids!!

Anyways.....I'm here in sunny L.A. wondering if they're gonna make me go the IR-1/CR-1 route.....we have filed both petitions but does the I-129 still mean anthing for someone who's been married for 16years?

being there that long why not roll with DCF. Most definately you meet the requirements.
Go for it and get it done quick.

You can do K3 if you want. I wouldn't advise it but the option is not taken off the table based on the length of the marriage.

just fill out your forms and turn them in at the embassy in Canada. you wont have to deal with uscis dos etc.. IF YOU ARE LUCKY,, and will get your issues sorted quickly.

Yep, DCF is the fastest way to go and since you qualify for DCF, go the IR-1 route. Check the guides here.

Additionally, there is a VJ Canada forum with lots of smart Canuks hiding out there drinking Timmy's and eating poutine.

If they're already in LA and have already filed both peititions already, I think DCF may be off the table as an option.

*have* you already moved to LA somehow without an approved visa?
