I'm on an F-1 student visa looking at adjusting status by marriage and have a question about whether I will need to obtain a waiver. I have no criminal record in Canada where I grew up but the only thing on my record in the USA was in 2002, during my first year of college I got a (misdeameanor) Minor in Possession of Alcohol, I was sentenced to a $225 and that was it, no other traffic violations or anything. It has been over 5 years ago and I have heard that it could be expunged. Even with that record I was still able to obtain a licence to practice in my profession, but of course US immigration could see it in a different light. Will I need a waiver for one misdemeanor? Is a minor in possession of alcohol considered a controlled substance violation?
