Full Version: LPR Status son here as tourist to file petition

My mom is in LPR status and i have a brother who is a japanese and carry a japanese passport as well , he came here as tourist , now my mom wants to apply for his petition while he staying here. My question is that are they going also the same process ? filing the I-130 first , then wait for the approval of it then file the AOS , or file then as the same time, 2nd question is while they are waiting for the approval of the petition is my brother have to apply for the non immigrant extension since he enter here as tourist ? or if they cannot file the petition what other option they can use so that my brother wont have to go back in japan? Can a student visa is one of the option ? Hope can get many response as i read some info in the uscis even though i understand most of them im quite confused. thanks

before she is but they divorce already , she has 10yrs GC , my brother is 16 yrs old
