Full Version: work permit and ssn for K3

just want to ask anyone who've gone through the K3 process what they did after they arrived in the US... do we apply for the SSN, EAD and AOS altogether or do one thing at a time? and how long do these usually take? smile.gif

you need to file AOS and EAD first. when you receive your EAD Card, then you can apply for your SSN.

Yes, you have to wait until you get either your EAD or AOS before you are authorized to work.

Some people who came in on K3 just apply for an EAD and wait until their 2nd wedding anniversary before applying for AOS so that they will get the 10yr GC and will no longer need to file for I-751.

It's up to you whether you want to do it that way too or just file for AOS (and EAD) right away.

You're legally allowed to work with only EAD but some employers will want your SSN too.

You're legally allowed to work with only EAD but some employers will want your SSN too.



All employers have to get a SSN from their employee's.... you have to either show your SSN or that you have applied for a SSN...

You can apply for a SS number as soon as you arrive in the US. It will have an EAD warning on it though. After you get your EAD you can return to the Social Security office and get a new card without the warning. Other VJers reccomend you go to the local office to get your SS number as you may not get one otherwise.

You can apply for an EAD only, but will pay for the EAD a second when you adjust status. The EAD is included in the $1010 fee.

As soon as you have the EAD and SSI number you are legal to work.

the OP is K-3. it's my understanding would need EAD or green card to apply for SSN.

Maybe you should re-read the quote you are using to say that yes they can get a SSN before EAD/Greencard on a K3...

Yes , K3 have to get EAD first , thats what i did coz i called the SSN office they said i have to show first the EAD card not only the receipt that we applied. My EAD process took 42 days only , its on my timeline . We gonna apply for SSN today.

LOL. That is exactly what I was saying by using the quote. To me the quote was self-explanatory. Sorry if you did not understand it.

Also, you must get a greencard before the red lettered SS card can be replaced. Sorry for the mis-information docjazzie.

so k3 basically cannot get an ssn before ead/gc? odd lol

when i got here i was on k1 so i went to the ssa office and the guy told me i should have a work authorization to get an ssn too... i was appalled and "demanded" no i want to get my ssn now coz what i've read on your "requirements" that an I-94 is enough for me to get the ssn. and i do need it "badly"... he was hesitant but i wasnt gona back out lol so he said ok get a priority number and wait for them to call you...

I'm on the same boat as with docjazzie...so, just to make things clear now (and if we did the right thing! wacko.gif )...we do need to file AOS and EAD first before we get to have our SSN and be able to work right? Coz i already sent my AOS and EAD and i'm afraid that i did the wrong thing... wacko.gif

I was also under the impression that when you get either your EAD or AOS you'll automatically get a SSN assigned to you but after reading this thread, it seems to me that they are 3 very different "concepts"...

Any additional clarification will be greatly appreciated! good.gif

the one who helped filing our aos said that its not necessary to get an ssn before filing the aos but it would be helpful and beneficial in my part he said (pertaining to getting a a bank account, insurance)... my friend filed for an aos without an ssn because she's running out of time and it went ok with her (she has now a gc)... although im speaking both k1 cases...

so correct me if i'm wrong, i can file for an EAD and once i get it, file for SSN then apply for a job and wait til we've been married for 2 years before filing for AOS. This way, I wont have to file for removal of conditions? An EAD cost $345 or something...

or we can file for AOS +EAD and will get an SSN automatically and wait around60-90 days before I can apply for a job. But if we do it this way, we still have to file for removal of conditions? An AOS $1010...

I was thinking of also waiting 90 days before our 2nd wedding anniversary to file AOS and not file for removal of conditions but that will be like not having the green card for like a year and that adds up to like 4-5 years before I could apply for a citizenship. Now I think the best thing to do is just file for AOS then removal of conditions and then citizenship after having the green card for 3 years.

Still saving for it. It will cost us $1610 for me and my daughter. I am going to file the EAD with AOS. I just stay at the apartment alone during day time while my husband works and my daughter goes to school. I work as an apartment manager although I am not allowed to work legally yet. It was my husband they hired technically but I do the collections, contract signing, cleaning the premises, reporting complains to the owner and showing vacant units to prospective applicants in behalf of him. In return we get 60% discount on a 2-bedroom 2-bathroom apartment. We do not have experience in property management yet so I guess that's why we don't get a full discount.

If I read your post correctly you do have a good gist. Either way you will pay the $1010 AOS. You may not have to file for removal of conditons depending upon the actual approval date on your greencard. If the approval date is after your two year anniversary you will not have to apply for removal of conditions. With USCIS delays who knows.

Thank you for asking about doc verification. I will call the first of next week because Grace told me the Embassy will not receive any verifications during Holy Week. Hopefully, we are in the verifications returned on the 28th.

Thanks, edp33. We'll wait til May or June to file for AOS. Just need to save a little money. Maybe i can risk it and work part time and just get paid cash.

Dave and I will be praying for you and your wife. I can just imagine how tough it is to be apart for more than a year.

Hi doc (and to all on the thread!),

I filed my AOS and EAD at the same time last Tuesday, March 25. Well, i also now have a good idea of what needs to be done. Well, i guess i did the right thing by applying AOS immediately after my arrival here. From the looks of it, either the AOS will get approved first or EAD...in any case i have plan A and plan B covered. Btw, my wife and i will probably visit the local office on Monday and try to get a SSN for me if they allow it. If they do, ill also try to get a driver's license ASAP and make myself useful around here by being the designated driver for my wife. hahaha!

Well, good luck and hope we get to work soon. Our spouses will need all the help they can get so that we can start building future we would like for ourselves.
