hello, i am newly married to a canadian citizen and i am an american citizen. i have a few questions i would like to ask.

1. if i file the 130 form and it gets approved....does this mean he can come to the states or do i have to file a vise for him to come. i know he can visit the usa on just his passport so i am alittle confused.

2. if he owes the government of canada money for a student loan, will that effect him in anyway?

3. does he have to stay in canda during this whole process starting with the 130 petition to the AOS?

4. i have been looking at time lines people have posted and i am wondering what is the average wait time for most of these forms to be processed.

5. at any point can he work in the states?


i know it is alot of questions but i have been researching the internet for a week now and have come up with answers to only half my questions so any help would be great smile.gif

1) The approved I-130 will then be sent on to NVC for processing, and then on to the Montreal consulate for CR-1 visa interview.

2) NO

3) No, he can visit the USA, keep in mind the POE officer can and sometimes do turn people back, he will need strong evidence that he will return to Canada.

5) After arriving in the USA on a CR-1 visa he can imediatly work, or if you try for the K-3 he will have to wait 90 days or longer to get EAD in order to work.
