Full Version: Can I stay in the US while waiting for I- 130 approval?

My Dad is a PR and he just got married here in the USA with a Brazilian.
They've been leaving together for the past two years. She has extended her visitor visa a few times and also gone back to Brazil when necessary to renew it.

I'm in the process of helping them with the I-130 (and I know that my Dad may become a citizen before she become legal) and my question is;

If when the I-130 is filled, the family member is legally in the USA, can this person waits here for its approval?

Or can it help justify when requesting for a visa extension?

A person cannot overstay their visitors visa, this will cause a big problem if and when they do interview for the immigrant visa that results from the I-130 filing.

Unfortunately, a pending I-130 will not help justify a visa extension. It might even make it more difficult to get one.
