Hello,
I am a US citizen permanent resident in Canada in process of becoming Canadian citizen. My husband is a Canadian citizen.
We live near the border and want to buy a home on the US side and would like to have my husband become a US citizen eventually.
I am also a stay at home mom. If we buy a home on the New York side and I file for a I-130 for my husband can we use his income, since he intends to
keep his job on the Canada side and just commute. I do not have any income at the moment because I am stay at home. His having a green card will
also eliminate any problems with potential border crossing every day.
We would file in Toronto, am I correct from reading all the posts that you can still file at a consulate?

Yes, you are correct that you can still file your petition at a consulate, the interview however will take place in Montreal (only 2 consulates in Canada perform interviews, MTL for IR1/CR1 visas and K visas, Vancouver handles K visas only).

The whole cross border income thing, in my opinion, is a bit of a grey area. There is someone else in the Canada forum right now who intends to use that same kind of income on the I-864 - http://www.visajourney.com/forums/index.php?showtopic=114987

As you will have assets, you might want to check out the assets portion of the I-864 as well.

i think once u get ur hubby a US GC he can explore canpass for border crossing, i guess its like ezpass lets u thru the custom toll gates.
