I went to check out infopass since we're approaching 90 days past my husband's NOA for EAD, and one of the options for reson for appointment is "It has been over 90 days since I-765 was filed, and I haven't received my EAD". Does this mean I have to wait until 90 days have passed to MAKE the appointment, or can I schedule an appointment NOW for a day next week when the 90 days will have passed?

We waited 90 days but it is very easy to get an appointment at our local office. I wish you luck. They were very helpful to us.

You can make the appointment now but it must be made for day 91 or later....

I did the exact same thing..got an infopass now for day 91...I think as long as you are
past the 90 days its ok.
