I am confused about how this actually works. My understanding is that is enables the beneficiary to work until the marriage when her status will change and will be able to get a job without this work stamp. Hence it being a 90 day work stamp (marriage must be within 90 days of entry). Am I close?

My fiancee already has a SSN from when she went to college in the states. Not sure if this has any bearing...

The temp EAD allows your fiancee to work for 90 days from the day she enters the country, not until marriage.

If she does not get the temp EAD she will need to wait until she gets the EAD (when you apply for AOS) or the greencard.

The temp EAD stamp that is issued at JFK and some land crossing is valid for 90 days from the date of entry... it does not expire on marriage... it expires on the same day as the I-94.... after that date you are no longer authorized for employment and wont be again until you have been approved for the 1 year EAD that you file for with the AOS. The 1 year EAD can take upto 90 days+ yo be approved so there could be quite a gap in employment authorization depending on how quickly you marry and file for AOS...

Assuming the OP's other half is entering the US on a K-1 visa, his/her status does change once married. The K-1 visa is only valid until the holder is married. Once married, this visa expires and the holder has no status until AOS is filed for. Filing for AOS puts them in a pending decision status.

Besides JFK, what point of entries give out the EAD stamp every time? You would think in a recession the government would want legal immigrants to work as soon as possible and receive the work authorization stamp 100% of the time at POE but I don't think they think like that.

If I enter on a K-3, can they grant me one until I receive the EAD together with my AOS? ;-)

I can give them a box of chocolates if they do!! whistling.gif

I can't stand the idea that I get into the US and cannot work for 3 months!! Yeah, I know : "go for a CR-1", but I want the faster of the two... so I am taking the risk and trying the K-3 spouse!

Fee apart, is there any difference in filing stand-alone or with aos?
If it is faster, I am willing to pay more...

It isnt faster but it is based on your visa so you would in fact get a EAD valid for the duration of your K3 visa. 2 years. I cant remember what category is filed for but it is not C-9 (that is what you use when filing with the AOS) I think that it is A-6 but check that on the instructions.
