I couldn't believe my eyes when I looked at the processing times for I-751's at Nebraska. Still on July 2006? That's insanity! I filed my I-751 back in July 2007 and I thought it must have been getting close so I decided to do some research.
Can someone who knows more than me help me with a few questions I have;

-My I-797C notice of action & 1 yr. extension expires on 7/2/08. Will they automatically send me an extension?

-Travelling back to Australia in December proved to be quite risky even though my extension says it's good for travel. I got completley grilled by both Australian and US Customs, I was barely allowed on my flight to L.A from Brisbane. Am I really trapped in the U.S until my form is processed? It's so frustrating!

-Why don't they transfer forms to the other service centers? California, for example, says they are already working on application filed in August 2007! In fact, everywhere else is up to nearly march 2007 except Nebraska!

I can't believe how frustrating establishing residency in the U.S is! I've been married now since april 2004 & a alien resident since 2001. This INS nightmare just keeps continuing. Surely there has to be a light at the end of the tunnel?

No. Once the extension expires you will not get another. I (and a number of us) have set up an info-pass so that I can get a stamp in my passport to allow me to travel.



I had some problems, but nothing I couldn't explain to them. This was with the extension though. not sure how it will work with the stamp.



They do. In fact, i'm surprised you haven't been transferred. I filed in Feb 07 and seem to be in the group of unlucky people that weren't transferred and have to wait for the applications to drip through Nebraska.
If you look at some of the other threads there is word going around that Nebraska aren't handling any I-751's



Yup. The idea is that it's to stop immigrants having false marriages in order to get 10yr green card and then they turn around and allow all illegal immigrants the option to becoming legal. Frustraing is a word.




Sorry I wasn't much help and very little reassurance. Just know that there are people, a lot of people, at Nebraska still waiting from the end of 06.

Im in the same boat (and a fellow aussie). I had an infopass appointment in Denver this past week to get my passport stamped. They gave me a 12 month extension, and they told me some info on Nebraska which I posted about...click here to see that post.

Regarding being grilled by immigration, that really sucks. Im a bit worried too as I am travelling back to oz in May and my extension letter (although expired by then) has my maiden name on it instead of my married name and they misspelled my middle name. The lady at Denver said I should be fine with my expired greencard and the stamp in my passport. Lets hope!

Anyway hope the info in my other post helps.

How is it fair that people who filed their I-751's later are having there cases transferred to faster processing centers while older one's (including mine) are stuck in limbo in Nebraska? Is there any legal recourse? This seems all VERY wrong. Or just the logic of the illogic?

So despairing, but somewhat reassuring to know i'm not alone

Ryan: I too am going through Nebraska but I am not too upset about reading of these delays - I have re-joined the forum as we go through the lifting of conditions process. My feeling is this - they will extend the residency for one year and if nothing happens in 9 months - my wife can file for citizenship. Whether she ever gets her 10 year card is irrelevant - isn't it? And I am aware that there are delays in processing citizenships but wouldn't the 10 year green-card be pointless if she can apply for citizenship and focus on that? Do you agree or do you have a different take on this? At least I don't see the need to be angry as some other people are posting in this forum. Good Luck

I need to read up more on the us immigration law, i profess a certain naiveness. How long does it take to apply for citizenship, and from what point in time is that measured (i.e established residency, 2yr. green card etc.)?

You have to call USCIS and request a "SERVICE Request " plus contact your congressman or you will be waiting a long ,long time .Nebraska is not processing I-751 applications anymore but they are not transfering the onces they have neither so it's up to us to make them move again
Some are saying that our applications are not important because we are here (bunch of crap of course) and we should be OK just waiting .I wish I could face one of these people

For a person married to a US citizen the residency requirement is 3 years - it starts from the date of the green card (not of marriage - a common misconception) - and you can file for citizenship 90 days before the 3 years are done - so if the ten year card has not been processed and you are at that 3 year time-frame, you can file for citizenship. And like I said before even that process has delays but then why would the ten-year card matter - at least that's how I see it. I am sorry that you are so upset but I would rather be with my wife here than be waiting for the K1 to be approved and not being able to see her or be with her (luckily it took just 5 months for the K1 for us). So, yes I feel lucky to be with her and not be waiting in limbo like some people might be. And my feeling about the ten-year card is - that its not a big deal since I want her to file for citizenship anyway. I see my situation as more than half full (and not half empty) - damn where is another Molson . Good Luck

And after you file N-400 and wait for two years or so what are you going to do ? Do you realize there is no more applications to file after that so you can speed up your N-400 ?

It took Nebraska almost 600 days for my K1 and since then I only had bad luck with them .
To bad I can't move from this stinking state of OH south to California somewhere so I can get over with Nebraska

My hubby file for his 10 year green card in August of 2006. He just got his green card this past Monday!

Congratulations And ahead of their posted processing time of July 5, 2006, too! NSC must be really cooking now!
