why would you need a texas tmeline, if speed is determined by FBI and by Local Office?

all Texas service center will do is communicate between the two

once FBI is done it will request an interview date from Loval Office and send your case there, and then it is very individual for each Local Office

here is my advice (copied from FAQ):

3) Find people with close to yours Priority Date (PD) from your Field Office on this forum or others, for example this one has lots of Field Office specific info:

4) wait until people with PD LATER then yours start receiving Interview letters, schedule Infopass - usually 2 weeks ahead, if still not received, go to Infopass and Inquire about case status - it may be

A. stuck on "Name Check" - then you are unlucky
B. "FBI Clear all checks and it's forwarded to Field Office , expect interview letter within 60 days"

either way go home and schedule another Infopass within 2 weeks - if no letter - schedule another Infopass in 2 more weeks,
if no letter within 4-6 weeks of fact that people who filed after you got their letters from your field office, start considering filing lawsuit against USCIS about delayed Name Check and read about it. your main document could be that that NOA1 gives you X amount of days and that is passed.
5) once you receive Interview letter - make sure you prepare for Civics and prepare to give evidence and clear confident answers for any abnormal parts of your application that could make you ineligible - it means within 3 (for US citizen spouses) or 5 years such things as: a lots of traveling, separate address with US spouse, job abroad, name change, oath word change, crime and legal issues, taxes, communism, terrorism etc.

6) if you happen to confuse Officer on Interview about your unclear eligibility, they may say "Approval pending" and they "need supervisor's approval of case", which may take another 2-4 month, but in this case you have much more right to file lawsuit - as your after interview letter states amount of days to expect decision.

Update:

I went to have my fingerprints taken this morning in San Antonio.

My appointment was for 0900, I was out of there by 0840. good.gif

I got to the application support center at 0700 and there were already people forming a line, even though the office did not open until 0800.

Since it was a bit chilly, I stayed in my car until about 0740 and then got in line. There were about 15 people in line in front of me at that point.

Around 0745, 20 more people were lined up behind me and two support center employees came out of a side door with a cart and clipboards. They checked everyone's I-797-C letters and IDs (the green card for Naturalization applicants) and handed people clipboards with a form to fill out (just basic information about yourself).

If you applied for Naturalization, be SURE to have your green card with you. It states on the letter that you need it and they were giving one guy who didn't have his one heck of a time about it (I'm not sure if they ultimately let him in or not).

I do want to point out that they had a sign talking about the terrorism threat level being "yellow" and that because of that only people with appointments for that day were allowed in the office. I'm saying that because in other threads I have seen people talking about going to the support center a few days early and being processed, unless you live close, I wouldn't risk it.

The "yellow" threat level also meant that you could not take in any packages, briefcases, etc. on top of the usual items that you can not take in (cell phones, cameras, recording equipment, food, drinks, etc). They had no problem with me taking a book inside (I had expected a longer wait as I had there when I got my picture and prints taken in 2005 to renew my green card).

Right at 0800, they opened the front door and a supervisor told everyone that people with appointments from 0800-0900 could come in, everyone else was to step to the back of the line.

She asked everyone for their appointment time as they stepped inside the door to make sure only the 0800-0900 appointment people came in.

Inside we all stood in a line going to three employees. The guy I went to looked over my filled out form, looked at my green card, looked at my hands (I guess to check and see if they could get good prints?) and then gave me a number (12).

My number was called around 0825. The girl went over my personal information with me to make sure their system showed everything correctly. Then she sprayed water on a cloth, wet my fingers with it, dried them with another cloth (so that they were just barely damp, which is what their system apparently likes) and took my prints.

She asked me to fill out comment card.

I asked her about the free civics study guide mentioned in the I-797-C letter, she pointed to a box and asked me to grab one.

I was out of there at 0840, I could not believe it. kicking.gif

The study guide is basically the same questions you can find on-line on the USCIS website, along with some more explanation/information about each answer (the booklet states that they don't test on that, but I'm going to study all the info to be safe). There is also a CD in the booklet where they read the questions and answers. Probably very handy if someone has a hard time reading or pronouncing English.

I'm going to call the FBI tomorrow to make sure they got the prints and see if they might have already sent the results back to USCIS (according to other posts, most of them go back within 5 minutes of being received).

The two numbers I have are 304-625-5590 and 304-625-2406.

Just tell them you had your fingerprints taken by USCIS and want to check on the status. They ask for your alien # and will tell you whether or not USCIS sent the fingerprints to the FBI and whether or not the FBI sent the research results back to USCIS.

They will not give you any information beyond this, so by calling them you will only be able to be sure that your fingerprints didn't get lost in USCIS' system somewhere without ever making it to the FBI.

Looking at other posts, the FBI usually responds within a few minutes of getting the prints (it's all done electronically now). According to their website their "official" time frame for non-criminal requests is 24 hours.

Just got off the phone with the FBI (304-625-5590, then options 2, 5, 3).

Fingerprinting results were sent back to USCIS yesterday, so now I'm waiting for the interview letter...

I guess I'll find out within a month if I get lucky... ;-)

According to the "official" website, they are processing 07/09/2007 applications in San Antonio now, but I have seen a lot of people talking about the timelines being completely inaccurate if you don't get hung up in the name check delay or anything out of the ordinary... The Houston field office shows the same date.

3/31/2008 - Touched
4/16/2008 - Received NOA, letter stated that they will return by check the extra fees they received from me. I will be notified if they need anything from me..

Until now, I am still waiting for any appointment for biometrics or other kind of stuff.My case is a little bit different because I am filing N400-thought 319b of INA. I am working overseas when I received my conditional GC and will file lifting of condition by the end of July because my card will expire on 16 November 2008.

I had included Fingerprint cards in the packet..This was done in the US Embassy kuwait. Will this be the reason why there is a delay on my timeline??

according to this website:

if you file at an overseas embassy you are still permitted to use fingerprinting cards (versus the electronic fingerprinting if you file in the states) and do not have to pay the Biometrics fee, thus the NOA stating they will refund you the extra fees (I'm guessing you paid to file the form and biometrics).

On the downside, paper fingerprinting cards probably take longer to clear.

You can call the FBI (304-625-5590, then options 2, 5, 3), give them your alien number and check on the status of the fingerprints. They will not give you any details, but will tell you if 1) they received a request for USCIS to check your fingerprints against their database and 2) if the check has been completed and the results sent back to USCIS.

Assuming those have been completed, you're in the same board I'm in.

I have been fingerprinted and am waiting for an interview date.

Interview dates can take a while. Since your green card expires in November, you may want to talk to the U.S. embassy to see if they are able to issue an I-551 stamp in your passport like USCIS does stateside.

The USCIS guideline is that if you filed your N400 6 months before the expiration of your green card, you do not need to renew it and they will issue you the stamp.

Not sure if they go by the date you mailed it or the date they received it.

If you can get the stamp, that will provide proof of your permanent residency for travel purposes and save you a few hundred $ that it would cost you to renew the green card again (which would be stupid).

1. Paper fingerprint cards likely take a while to process. See my earlier post for the FBI phone number to check on status.
2. No, see my earlier post for details.

I just went to check on my case status and got a "Case Status Retrieval Failed" error.

From what I understand from other posts, that's a sign that I should get an interview letter in a week or so, I'm hoping... unsure.gif

I called FBI by using above number, and they said that my fingerprints were sent back to USCIS, they told me after that the name check is being done, by different department in washington DC..
So there is 2 checks with FBI.
my fingerprints were done on 7 april 08, and FBI sent the results back the same day.
Name check, started...
who knows how long???

Depends on your name and if it matches/is close to any known terrorists/criminals.

Basically they compare your name with all the terrorist watch lists and criminal records. If you come up clean, USCIS continues the process, it might only hold you up for a day.

If you aren't that lucky, your name matches someone on a terrorist list or criminal record and someone has to manually verify that you are not that person. That can take months or, in some cases, years.

The FBI department doing the name checks does not accept inquiries, so there is no way for you to check with the FBI directly, you would need to go through USCIS for any updates.

4/16/2008 - Received NOA, letter stated that they will return by check the extra fees they received from me. I will be notified if they need anything from me..

Until now, I am still waiting for any appointment for biometrics or other kind of stuff.My case is a little bit different because I am filing N400-thought 319b of INA. I am working overseas when I received my conditional GC and will file lifting of condition by the end of July because my card will expire on 16 November 2008.

I had included Fingerprint cards in the packet..This was done in the US Embassy kuwait. Will this be the reason why there is a delay on my timeline??








I called FBI by using above number, and they said that my fingerprints were sent back to USCIS, they told me after that the name check is being done, by different department in washington DC..
So there is 2 checks with FBI.
my fingerprints were done on 7 april 08, and FBI sent the results back the same day.
Name check, started...
who knows how long???



Hey when i called uscis i talked to IO. She said that my A file was ordered from national record center..

Who schedules and send the interview letter, Texas service center or the local office?

I filed in april and got my biometric done as well as cleared by FBI. Expecting the interview letter in a month time-frame.

It is my understanding that the case stays with the service center until the fingerprints and name check have cleared, then it gets sent to the local office (thus the case status disappearing for some people if USCIS actually updates their system) and they actually schedule the interview.

Had my interview on 06/06 in San Antonio and the interviewed recommended my application be APPROVED!!! good.gif

Though the details below look like it was a long interview, it took all of 20 minutes, including 5 minutes to go up to the interviewer's office and back down.

Here are the details I remember, if you're interested...
  • I arrived at the office 30 minutes before my scheduled interview time (the letter said not to go there any earlier than that). The guard at the entrance took my interview letter (it was never returned to me, so be sure to make a copy if you want to keep as copy as memorabilia)
  • My name was called by a female Latino interviewer 5 minutes before my scheduled time.
  • We went up to her office. Judging by the title on her office door, she seems to be "the big boss" and I was wondering if I might be in trouble (I figured maybe she'd be more thorough that a "normal" officer).
  • She asked to see my green card and drivers license.
  • She seemed to have the complete file on me, including all the paperwork from when I got my green card 13 years ago. She asked me if it was correct that I received my green card through the visa lottery and how I originally came to the U.S. Once I verified the information and answered her questing, she told me I was lucky.
  • At that point another women entered, it turned out that that woman was being trained to interview people (I found out later that she interviewed people before, but that it had been 9 years since she did) and as the officer went through the interview process with me, she pointed things out to the trainee.
  • She officer started going down my application, verified the address and asked to see my passport.
  • I told her that the "leaving the U.S." dates for travel on my application were approximate (Germany doesn't stamp their passport when you entry, so the only dates I knew for sure were the return dates to the U.S. when U.S. Immigration stamped my passport, she said that was fine.
  • She asked about my last trip outside the U.S.
  • She asked about me being married and how long, as well as my honeymoon (my application was based on five years of permanent residency, not marriage).
  • She asked about my place of employment and what I did there. I answered a questionand told her I had a "Letter of Employment" from my employer if she wanted it. She told me she have to have one, but if I had one, she would take it.
  • Then we got to the section about ever having been cited/detained/arrested. I told her I had actually forgotten to put a ticket for low tire thread on there. She told me that as long as the tickets weren't for DUI or reckless driving, it didn't really matter and she wrote something across the three tickets I had filled in on the form (probably to that affect). She explained to her trainee that some people put tickets because the question asks if they ever were cited and that since a ticket is a citation they put it. She said some people didn't put tickets down and that was find too (if it wasn't for DUI or reckless driving). I mentioned that that subject causes a lot of discussions on immigration boards and that people put the tickets for the reason she mentioned, but also because the question reads if you have ever been detained and technically when a police officer pulls you over, you are detained. The officer looked at me funny and then her trainee told her I was right since you can't just leave while the police officer has you pulled over. After this little chat, the conversation went from a serious interview to more of a chat.
  • She asked me my father's name and checked a copy of the birth certificate they had on file from when I originally got my green card.
  • She asked to see my selective service registration letter (apparently that's a big deal, because she told the trainee that if someone doesn't have that, they have to check on the computer to see if someone shows registered or not).
  • She went through the all the "moral" questions in the end of the form and made me answer them as well as asking me each line of the Oath to see if I supported it.
  • She made me sign the N-400 as well both of my pictures and another paper (looked like a Naturalization certificate) in ink
  • She asked me to answer 10 civics questions (verbally), the "old" test, straight out of the "Learn About the United States" booklet you can pick up when you get fingerprinted (or get from USCIS' website as a booklet or flash cards):
    -Where is the White House Located? (Washington, D.C.)
    -Who wrote the "Star Spangled Banner?" (Francis Scott Key)
    -What are the names of the two Senators from my State? (for Texas, Kay Bailey Hutchison and John Coryn - I had to think for about 20 seconds to come up with last name of Senator Coryn)
    -What is the supreme law of the United States (The Constitution)
    -Who is the Chief justice of the Supreme Court? (John G. Roberts, Jr.)
    -In what month is the new President inaugurated? (January)
    -What is the legislative branch of our government? (Congress)
    -Name the amendments that guarantee or address voting rights. (15th, 19th, 24th, 26th)
    -What did the Emancipation Proclamation do? (It freed the Slaves)
    -How many Supreme Court Justices are there? (9)
  • She asked me to read the first question of the civics test (which she had printed out)
  • She asked me to write "They live in the United States."
  • She congratulated me and told me she was going to approve my application.
  • She handed me a form "N-562 Naturalization Interview Results) stating the above
  • She congratulated me again and told me that if final approval is granted, I should get a letter with an Oath date within 90 days
  • She reminded me that I was not a U.S. Citizen until after the Oath date
  • When we went back downstairs in the elevator, both ladies were very happy that the interview didn't take long because now they were ahead of schedule and the trainee would be able to interview the next person and take her time

The Oath ceremony is July 23 in San Antonio.

I was hoping for one in Austin, but for the citizenship, I'll take one more trip down to San Antone... laughing.gif

Unless something dramatic happens, this completes my journey, here is my full timeline.

I have to say that I have been impressed with the speed and courtesy of USCIS.
