Hi Guys
Really i am looking for some clarification on this....
My K1 expires april 20th, I have the work stamp as i came through JFK.
Now, I have just been hired with a large financial institution and start that job March 17th.
We sent away our AOS package March 10th.
What is the chance of the work authorization coming through before the deadline of April 20th?
I basically have 1 month for it to come!

That is correct.

You might be cutting it really close to get that EAD.

Your work stamp is valid until the "valid to" date on the I-94 that you were given when entering the country.

Getting married doesn't invalidate the K1. The K1 is a visa which allows you to enter and remain legally in the country for the purpose of getting married, and which allows you to adjust status to legal permanent resident. If the K1 were invalidated with marriage then any K1 holder who gets married would be immediately out of status until they filed AOS.

I strongly doubt you'll get EAD in a month, 74 days is the average at the moment. Speak to your employer, they might be able to work something out. maybe they'll just not pay you for the time you're out of work authorisation, then when you get EAD give you a "surprise bonus" for being a good egg. smile.gif

This is not correct, just for clarification. The temp EAD given from the POE is effective until the date on the I-94. It is not rendered void with marriage.

Rebeccajo is correct - the probability of an approval by the time needed is most likely zero.

I second what Rebecca has said already... the chances of getting an EAD processed in 1 month are slim at best. I believe (unless things have changed) that the USCIS aims to get EAD's processed in 90 days and if you've not had a RFE or an approval by the 90th day you can arrange an infopass appointment to request an update. Interim EAD's are no longer issued so even once that request has been made, there is still more waiting to do until your card finally arrives.

I think you should contact your prospective employer and explain the situation to them. Like anything in this bloody process, it's almost impossible to say when your EAD will be approved. Mine took 5 months and congressional involvement !! Maybe you'll get lucky and they will keep the position open until your EAD is approved ??

Also, the K1 visa itself is null and void after the alien enters at POE. Their status is then derived off the I 94 - and once that is expired, the status is then derived off the pending AOS application.

They can't just not pay you, the issue is you are not work authorized between the JFK stamp expiring & EAD coming... so you can't work.

I'd recommend chatting this over with your prospective employer before you start.
