It's been a long time since I last posted anything on Visa Journey. I remember going into the consulate interview and being gratful that we had been granted my green card and very happy. I got a job and started to becoming a paying taxes. Then - we became not so happy. My US husband filed for divorce 119 days after I moved in. I lost my new job and had to move in with freinds. Ex- hubby has been charged with a domestic violence charge (misdemeaner) and attemped burglery (felony) as he thought it was okay to force into my room that I now call home.

I spoke to my immigration lawyer and he says I'm ok and that my I-751 can still be filed with a waiver without ex-huband. Can anyone tell me if you on removing the conditions and requesting your 10 year PRC do you still have an interview in attend for this approval or do they just look at the paper documents as submitted and make the decession based on that.

It varies. Some people are called in for an interview while others are not. You are certainly allowed to file on your own by requesting the waiver from filing jointly (there is a box to click on the form). You do need to be divorced by the time you file, however, not just in divorce proceedings. Good luck and I am sorry it didn't work out for you.

Even though you will be filing under a waiver for the joint filing (by ticking the box mentioned by Kathryn), you will still need to show proof that the marriage was entered into in good faith and was a real marriage while it lasted. This means you will need to submit copies of joint account statements, joint bills, etc.
