I think you should wait until Monday and call CSC about the C #2 thing. I don't know about the waiver...I didn't think it was required, but maybe I'm wrong. I'd ask them about that, too. Hopefully you'll get someone helpful who will give you good information. You could also post it on the K-1 Fiance(e) Visa Process & Procedrues General Discussion forum...hopefully some knowledgeable VJer will be able to give you better info.

If you only previously filed one K-1 petition in your lifetime and it was in 1991, you're not required to submit a waiver. However, it seems that the USCIS (still) doesn't understand the requirements. Since they want one from you, it's not too difficult to do. There is no form. You just need to create your own.....there is no specified format. I titled mine "Request for Waiver From K-1 Visa Petition Filing Limitation". Basically, I just briefly noted the applicable requirements under IMBRA, noted how they applied to my circumstances, briefly discussed the previous K-1 circumstances, and then simply requested a waiver from the IMBRA requirements so that I could file my new petition for my fiancee. You might also note that you don't believe that you are required to file a waiver, but you are doing so in order to avoid any question of applicability to your circumstances.....or something to that effect. Finally, sign and date the request.

As far as their comment on your I-129F, who knows why they said that. I'd suggest that you very politely note that your original I-129F did have an answer to Part C # 2 and include a photocopy of that form in your RFE response.

You are exactly right, my frustrations are not directed at anyone here. I have e-mailed NVC at their inquiry address, and am working on the congressman/ senator side. I have difficulties being able to call their offices as the vessel I work on spends most of the day outside of cell range at sea only to return to the dock at night.


I understand your situation better now.....it's not so easy for you to have contact with your Congressman's or Senator's office. If you can afford tp take a day off to see them, it might be worth your while....at least make you feel better. BTW, I finally received a reply to one of my NVC email inquiries.......yesterday....now that my petition is already in Moscow.

I can certainly relate to and understand your frustration. Hope that you get some good news soon!

Unfortunately, I won't be able to take a day off. My rotations are 3 weeks on/ 3 weeks off with the boat being in seattle and I living in Denver. I won't be home again until August 20th. I do have the addresses/numbers for my congressman, though his page said I need to mail or fax the privacy release form to his office before he will do anything. I'm going to try sending it as a PDF file to his office.

At least they wrote back, did you send your inquiry from a yahoo address by chance? I have read other places on here that sometimes they don't hear back if they use a yahoo address.

You're quite right, Ray - I was refering to the ones with whom I've become familiar on this thread.

Having said that though, I seem to recall there being 50-odd on the list a couple of weeks ago, so it's all good.

On Saturday, I received a letter from the NVC that was dated July 30th, and it states they have my approved petition (I already knew that) and gave me my new KEV case number (I also knew that), and said it would be shipped to Kiev "within one week". I plan on calling back tonight! wink.gif

Additionally, I have received good news from my fiance. I have always wanted to attend the interview with her and fly home with her, but was afraid that I would not have enough vacation time to wait for the approved visa to be shipped to her house. I only have 7 paid days left and if it took 6 or 7 days to arrive to her small city, I would be in trouble. Well, she spoke to the FedEx desk in Kiev that handles the visa deliveries for the Embassy and they told her that we can pick it up directly from their office!! When we pay for the fedEx services, we are to give them our contact phone number and a note will be placed on it. They will attempt to call us twice before going ahead with shipping. They also said it would be good if we called them, as well, to make certain it does not sneak past. So, if the Embassy takes a day or two to process it after the interview (I really have no idea how long it takes, but the Embassy site said the visas are normally delivered in 2 to 4 days), we can stay in Kiev and pick it up and then travel back to her home. This will still give us about 4 or 5 days to pack and visit friends and relatives before heading back to Kiev for the trip to the USA! I know Sveta is so much happier and relieved to know I can be with her every step of the way. biggrin.gif

Now that we're getting to the interviewing stage, etc...if everyone will send me a PM with their current status (ie. packet 3 rcvd, sent back, packet 4 received if applicable, interview scheduled, interview date, etc) I'll keep a list of it. I totally understand! I need to get my affidavit of support notarized and collect all of my paycheck stubs between now and the interview...then I'm all ready! I'm so excited! I also found out last week that I'll be able to attend the interview, which makes me VERY happy. I thought that I would have to miss it because I don't have enough vacation time, but my boss and HR manager made a special arrangement for me. They made it very clear that it's a one-time ONLY deal because of the situation...it's so nice to have understanding management! biggrin.gif

GREAT!! I am glad they are being flexible for you! My company also has a policy where they 'may' grant an extra week of vacation for some situaitons, such as marriage, birth, and adoption. I have already told my managers that I am planning on taking that week later this year when we get married. :-) And, since I am Team Lead on my job, I can do a lot of things working from home and not have to be onsite, so today I decided that since I will not have any vacation time left to spend with my ladies once they arrive, I will work from home for a couple of days--at least--to make sure they are able to function (like find the dishes, food, eat, etc..hahaha). I just hope I am not too distracted to do any work! innocent.gif

I also found out last week that I'll be able to attend the interview, which makes me VERY happy. I thought that I would have to miss it because I don't have enough vacation time, but my boss and HR manager made a special arrangement for me. They made it very clear that it's a one-time ONLY deal because of the situation...it's so nice to have understanding management! biggrin.gif


GREAT!! I am glad they are being flexible for you! My company also has a policy where they 'may' grant an extra week of vacation for some situaitons, such as marriage, birth, and adoption. I have already told my managers that I am planning on taking that week later this year when we get married. :-) And, since I am Team Lead on my job, I can do a lot of things working from home and not have to be onsite, so today I decided that since I will not have any vacation time left to spend with my ladies once they arrive, I will work from home for a couple of days--at least--to make sure they are able to function (like find the dishes, food, eat, etc..hahaha). I just hope I am not too distracted to do any work! innocent.gif

Have you tried calling CSC? Just call their number and follow the steps for information on an RFE, then ask the person who answers the phone about your petition. Be really, really polite and hopefully they'll be able to help you! A lot of people have been approved without any emails or touches...the NOA2 just showed up in their mailbox. good.gif I hope you hear something soon!

Thanks!! I think in our situation it is even more important with the language barrier. Sveta knows the English language but has zero confidence in it. I have a lot of confidence in her, and I know she will adapt once immersed in the language. Her daughter is still learning, so she has a ways to go. Sveta has flown only once before and it was 20 years ago. She has never flown internationally, and her daughter has never been on a plane, either. I want to be with them to reassure them throughout the entire travel period. Sveta has helped me tremendously when I am there since I am not good with Russian or Ukrainian, and it is only fair that I be her support for this major change in their lives. energy.gif

huh.gif I called the NVC a few minutes ago and as of then, our case was 'still in administrative processing'. So much for a quick turn-around of 2 or 3 days. They received mine on the 25th, and I have had two letters from them (like many others have received) that both say the same thing, but have a different date. My letters were dated the 30th and 31st, respectively. Patience is a virtue, but I am not feeling very virtuous these days! blush.gif whistling.gif

Nail on head. Like I told cwaf before, after the carry on with CSC/USCIS, I'm just going to plod along quietly, and wait for packet 3 to drop through my letterbox. I'm calling no ######.

Im soooooooooooooooo happy!! so for those who had an RFE don't lose hope. its just a few days delay in the approval... can't wait to call my fiance. i'm soo happy!!!! Okay so I was finally able to make some phone calls today, First was my congressman, who I had to leave a voice message with, then I called CSC to see if i could get a live person. After waiting over 20 minutes the guy answered. I told him my situation about being over 6 weeks and my case hasn't made it to the NVC. He said he has an idea where my file is, but will have to order it which could take about a week, and then have it mailed to the NVC which he said I should allow 30 days for.

Has anyone else heard of this, them having to "order" a file. I asked him what happened and he wasn't very clear on it. Just saying he was ordering it right now and that I should wait.

So, in the mean time I am waiting for a call back from the congressmans office. I'll keep updating when I can. unsure.gif unsure.gif

Hi nginear, I'm sorry that your case has not yet reach NVC. Honestly I have no idea about it but maybe you can call back CSC again to verify the information given you by that person. I'm thinking maybe they will send another file to NVC. Just keep calling if you can. Hopefully you will receive good news soon.
