I received my RFE in the mail today. They said "Your I-129F petition is incomplete. Attached, please complete Part C #2, circled red"
I did not receive anything circled in red. Also I looked at my copy of the I-129F I sent and I answered Part C #2. This ever happen to anyone else? Should I just send them a copy of my I-129F?
Also I filed a K-1 in 1991 and they tell me I need a waiver. Is there a form for that? Or do you just send a letter explaining the circumstances?
If you only previously filed one K-1 petition in your lifetime and it was in 1991, you're not required to submit a waiver. However, it seems that the USCIS (still) doesn't understand the requirements. Since they want one from you, it's not too difficult to do. There is no form. You just need to create your own.....there is no specified format. I titled mine "Request for Waiver From K-1 Visa Petition Filing Limitation". Basically, I just briefly noted the applicable requirements under IMBRA, noted how they applied to my circumstances, briefly discussed the previous K-1 circumstances, and then simply requested a waiver from the IMBRA requirements so that I could file my new petition for my fiancee. You might also note that you don't believe that you are required to file a waiver, but you are doing so in order to avoid any question of applicability to your circumstances.....or something to that effect. Finally, sign and date the request.
As far as their comment on your I-129F, who knows why they said that. I'd suggest that you very politely note that your original I-129F did have an answer to Part C # 2 and include a photocopy of that form in your RFE response.
