Hello everyone! I have a problem right now. I am planning to go out of the country by Dec 17 til Jan 2 and my greencard will expire on Jan 29, 2009. Is it okay to file my paperwork to USCIS two weeks before the 90 day period starts? Or i have to file w/in the 90 day period? I want to file early so that hopefully my biometrics wont be on or before dec 17 in which i will be out of the the country by that time. Hope you can give advice on this. I badly need it huhuh sad.gif Thank you in advance!

You have to file within the 90 day period. If you file early they will return your application. I believe if the biometric data is not convenient you have the option of calling and trying to reschedule. Good luck.

dont do it just wait and do it with it 90 days i don't think they will send back but then you will have to wait like me 2 years to get your papper be patience do it when it suppose to or they;ll think that you are the most desperate guy who wants his gc sooner then others do be smart

dont file before the 90 days start, your petition will be returned! If the date and time they schedule your fingerprinting for isnt a good time for you you can call and reschedule!!

Unless I am misunderstanding your post, why can't you file before you go on vacation ? If your green card expires Jan 29th, 2009, you can send in your packet any time after Nov 1st, 2008 (I think that is exactly 90 days before Jan 29th 2009 ??). That way it's all done and you don't have to worry about it after your vacation.

However... you'd still have 27 days to get it in the mail after getting back from vacation anyway. As long as the packet is post marked before the date of your green card expiration you should be good to go. Lots of people (for various reasons) wait until just before expiration of their greencard before filing. I personally had around 30 days of my 90 days left when I sent my packet in.

Edited to add:... You can reschedule your biometrics once you get the appointment. If someone can check your mail while you're away they can find out when the biometrics has been scheduled for. Sending in the packet after you get back should avoid any potential scheduling clashes.

If you are that worried, send it after your vacation. Have everything all ready to go in the envelope before your vacation, and then go to the post office on Jan 3rd. That makes the most sense to me, but you could also reschedule biometric appointments.

According to this post, currently you can apply 6 months before blink.gif - as opposed to 90 days. This is suppposedly what they tell you when you call. So you could try calling in July and if you get that message you can try to apply. This way you might even get the biometrics before you leave! innocent.gif

I sent mine in a few weeks early and they returned my application in an envelop and a few days later a bigger envelop with all my evidence. From experience, filing early is a waste of your time, they will just send it back to you.

I have decided to mail the paperwork when im back here in the US so when im on vacation I wont have any worries with the biometrics date. Thank you guys for all your advice! I truuuuuly appreciate it!!!! God bless you all!
