Full Version: My Mom's F4 peition

unsure.gif THe situation: My mom was petiitoned by her US citizen sister back in 1986. And so right now Mom has received a notice from USCIS asking her toi return a letter which proves that she is interested on the said petition. But here's the catch, my Dad is here in the US where in he entered as a tourist and now is under an employer who is peitions him as a non-skilled worker. My mom wants to include my dad and my youngest sister whose 19 as her beneficiary but when she consulted an agent, they told her that my dad needs to go home in the Philippines for she could not move and start the procedure without my father being there. I'm assuming his saying what is the point of incluiding my dad as one of the applicant when he is not around during the process? Now my questions are, can he be petitioned under my mom's F4 here in the US? Should my mom exclude him and continue my dad's work visa ? Or does he really need to be back home? Won't that affect his re-entry since he forfeited his tourist visa privilege into being under an employer?

A Family based Greencard is much better than a work visa/ possiblity of employer sponsorship.

What status is your father on now. How did he obtain such status.

Your father will need to return to the Phillipines for the interview, why is that a problem?
